Has anyone actually challenged the legality of using clamps on cars , they are your own property, wouldn't it be illegal to restrict your use of it? I do realise that court orders and bailiffs can be used, but these seem to be two different things? Sorry for asking as I simply don't know, also has anyone tried to petition the new government to change the laws on this and ban clamps like in scotland? Perhaps it might be an idea if MSE got behind it?

Unfortunately, the Court of Appeal ruled in Arthur v Anker that private clamping is lawful in England and Wales, supposedly based on the principle that the motorist has "consented" to the clamping [the Scottish courts came to the opposite conclusion].
The consequence of this ruling is that cowboy clampers are, in practice, free to clamp unlawfully and ignore CCJs with complete impunity, and full police support by way of the threat of arrest for "criminal damage" if the victim cuts off the trespassing clamp. :mad:
If you have a few hundred thousand pounds spare you could try taking it to the ECJ [citing the EU Directive on which the Consumer Protection from Unfair Trading Regulations 2008 are based] or the ECHR [since the State should not be licensing the "fining" of private citizens by other private citizens over an alleged debt imposed for an alleged trespass].0 -
If a car is causing a hazard, it goes against complete logic to clamp it.
Imagine a car is parked at the bottom of your drive-way so you can't get your car out, the logic thing would be to move said blocking car not lock it into place.
The worst clampers are those whom roam freely without contracts with the land-owner only accept cash and are completely unregistered giving you false information when requested.0 -
