RBS "Lost" £7000 :@

Im sooooooo f***ed off right now, i went to the bank today with my brother in law who was holding onto £7000 for us for our wedding fund, thing is i asked him a few weeks ago to transfer it to my account so i could start paying deposits and OH wants driving lessons...
Anyway to cut a long story short he transfered it 2 weeks ago and i still havent recieved it yet, so i went to find out whats happened. Apparently I gave them the wrong details for my account which is kinda hard as i had my card in my hand when he asked my details while transfering it.

They have no idea where the moneys gone but will investigate and the wee spotty speccy muppet serving had no idea what happened next or how long it took.
Im absolutly fumming and have no idea what to do next thankfully i can put off caterers for a few weeks yet before they will need paid. Does anyone have any idea how long this sort of thing takes? or will I ever see the money again?

Grr, I need a smoke.. i should sue them for damages to my health ive been chain smoking all day and Im supposed to have quit :@

If your brother in law sent the money I think he has to log the complaint? I am not sure but just thought I would let you know he might need to get onto them too to get the ball rolling as quickly as possible!!

  • So you or your brother transferred the money to wrong details and that is somehow RBS's fault

Typos happen. I gave a cashier my new address on a slip of paper, but she managed to type 33 instead of 32. I can also remember many years ago a christmas giro that was paid into a wrong bank account simply because the clerk had typed a number wrongly.

You won't get anyone from front of house to admit to the error or accept responsibilty. They should be able to direct you to someone who can give a definitive answer though. Failing that call the ombudsman.

    Hi,

    Couple of questions for you:

    1. How did he transfer the money ... via the internet, where he had to put the details of your bank a/c in? via the bank, where he/you gave the no across to the teller?
    2. If it was the 2nd method - do you have a reciept & what does it say?

dont rbs have a record on computer of what account the money was paid into if they do they can contact that account holder and get your money back
If money gets sent to the wrong account and the fault is on the part of the customer, rather than the bank, the bank cannot just "dip" into the recipients account to reclaim it.

If this was a bank transfer made by the individual themselves then it cannot be recalled if it has gone to a valid account. If it has gone to an account that does not exist it will eventually bounce back.

However, if it has been received by someone then morally they should give it back although legally there is now way they can be forced to. If the transfer was done at a bank counter and the bank got it wrong then you have a case against the bank.

As an ebay seller we are always suggesting that bank transfers are the absolute best way to get payment as there is nothing at all that can get the money back once it has 'cleared' overnight in the recipient account, banks are not even obliged to contact the recipient.

Let me see if I've got this straight - if someone transfer thousands of pounds my mistake into by bank account, I can keep it and do what I want with it???

If you were morally corrupt then you could make them work very hard to give it back. The payment would have been made to you voluntarily it would be the same if someone gave you £1000 in the street as a gift and then a week later came and said they had changed their mind. That's why when we make transfers online it is very very important that the details are completely correct. Obviously most people I am sure if faced with a transfer into their accountthey don't recognise would willingly co operate with the bank to give it back. However, moral and legal decisions are not always the same.

Look at it the other way. I sell a laptop for £2000 and for safety get the buyer to make a bank transfer then meet him the pub and hand over my laptop. A couple of weeks later buyer says 'oh don't know why I sent that money to someone I don't know can I have it back please..and bank just take it back or email seller and say please give it back as Mr X says he didn't mean to pay you. Or what about if you paid £5000 cash into an account and accidentally filled out the paying in slip wrong , would the bank just open the till and hand you back used tenners a week later or would they ask you why you paid it in the first place.

It is a completely different matter if a mistake was made internally by the bank or by a bank employee.

If the money ws sent then presumably your brother in law will have signed the paperworked after it was keyed or agreed to payment on Chip and Pin and he would have had opportunity to check the details of recipient. If he signed when details were incorrect then its not the banks fault.
