Hi this is my first post! Does anyone have any experience of claiming back PPI with GE Money?
I have a Dorothy Perkins store card that I took out in 2000. I used the first letter template and received the reply that as my card was taken out so long ago I wouldnt be able to claim. They also sent a copy of the agreement that I signed, saying that I chose to sign for PPI. At the time I was told by the sales person to sign where she indicated and this shows on the agreement as she has ticked areas that I was told to fill in.
Do you think I stand a chance in sending the second letter out? I really didn't know I was paying insurance on this card until I checked out this site.
I also did a reclaim for my mom on an A&L as she has always been self employed and she received £560. They gave her the PPI paid to date plus the 8% interest as per letter 1!!! A&L offered her this settlement after sending the first letter no arguments!:T:T:T

I would write back to them if this was not the final response, there may be other ways around this, if the financial ombudsman are unable to help, if the company were not covered or under jurisdiction by GISC before the FSA came in in Jan 2005, maybe you could go for small claims court, but wait for other opinions on this hun, there is no reason why you should not write back and try until the final response is received.
It's so annoying that because your case was not covered, they fob you off as they think they can get out of it then, but hopefully there are ways around this.
You can tell them if they do not uphold and refund you, you will seek advice on how you can take this matter further, it may make them think about it.

I wondered whether anyone could advise me where to go next with my PPI reclaiming.
The story:
I took out a store card at a Dorothy Perkins store in 2000. I signed up at the till when asked by an assistant if I wanted credit. I genuinely did not know that insurance was added to the application and was not told about this.
I sent out the first letter template to GE Money at the end of March 09. I used the misselling, and the fact that that GE had been fined as my basis.- GE wrote back 2 days later rejecting my claim telling me that I had requested the PPI at the point of sale as my signature was on the agreement. They also sent me a copy of the original agreement. This copy shows crosses that the store assistant had placed in the areas where I was to fill in and sign. Because of my signature GE said that I had clearly elected to take out the insurance and that no records of the transaction were required by Law to be kept at the time and that therefore I had no proof of what happened and must have been made aware of the policy. They informed me that I would have had a 30 day cooling off period where I could have cancelled the insurance and that it was my responsibility to cancel the policy if I didnt want it. I hadn't done this so obviously I wanted the policy.
- They dismissed the fact that they had been fined.
- They also informed me that in 2003 the policy had been upgraded! I'm not sure why, and again I would have had a 30 day cooling off period following this change to let them know if I wasnt happy!! If only I had known!!!
- They explained that they had now cancelled the policy and that I should contact them again retrospectivley to reopen it.
I contacted the FLA by email letting them know my complaint and that had I known that I had a policy I would have claimed when I was out of work for 3 months last year and that I am currently out of work. I think the FLA sent out my email directly to GE as a couple of days later I was sent a letter CC to FLA from GE to say they had looked again at the case, I had no claim due to:- I had signed the agreement and had elected to take out the policy and must have been told at the point of sale.
- That there had been an upgrade that I was told about (NOT) and that I could have cancelled this retrospectivly within 30 days in 2003. They listed all the wonderful benefits I could have had thanks to this upgrade!
- That I should re-start the policy if I was now out of work and try to claim up to the point that they cancelled the policy.
- They also said that my statements clearly show that I had a policy, so I was aware all along. My last statement says "accident @ 1.99 per £100".
- And again that this brought closure to the matter.
I have decided that I would like to continue to fight this decision, but wonder if anyone has any advice on whether its worth the effort. I really had no idea unil March this year and Martin's public announcements on PPI misselling that I had a policy. Heck I would have claimed last year when I was out of work instead of struggling!
Does anyone know whether this "upgrade" that happened at the end of 2003 means that I can ask the FOS to look at my case. I can't beleive that a company can make decisions on my behalf and then expect me to respond retrospectivley. That seems so unfair when you don't know whats going on.
I have no doubt that I signed up for a credit agreement with GE but I did not sign up for the insurance.

Sorry to hear of your ordeal here.
I take it then these were not covered or under jurisdiction until Jan 2005 when the FSA taken over GISC, and the Financial ombudsman service (FOS) are only able to look at these complaints if they were covered by these regulators as such at the time you taken this out, not all of the finance companies were covered by GISC either unfortunately.
It looks as if you've had a standard response from them, as they know you cannot take this to the FOS, but maybe you could ask your Local CAB if they can look into this for you.
I don't think they were fined until Jan 2005 onwards, but I'm sure others who have had dealings with these may post up with some info/advice for you here.
Are the FLA able to help you at all then?
I know not everyone are successful with asking the FLA, but some have been lucky with them, not a huge amount though, but other than that, seek further advice from your local CAB, I imagine they are used to dealing with these matters.

I totally agree with what di3004 has said above, in addition to that, if you have the original Loan Agreement that should be enough to warrant a claim either by yourself or through a company.
They obviously want you to believe you haven't been 'mis-sold' the PPI and that you willingly agreed to it, that would be true if you hadn't been overcharged (which you probably have) and if G.E Money hadn't made commission on it (which they have).
Why do you think the government are banning all PPI policies at the end of May 2009?
They want you to believe they were legally allowed to sell you that policy, but the truth couldn't be further from that. Hence, this whole uproar!

Thanks for the advice on my store card saga!!
GE money are making it clear to me that I have no claim with the FOS and are rubbing their hands as with glee as they think they have my claim tied up with a ribbon.
The FLA really have just played postman forwarding the email I sent them onto GE. It wasn't until I sent a few emails letting them know that I will take this further and I really do feel that I was missold that they advised CAB. I know they are a mediation service but I felt that they really were not interested in my case.
The thing that I find disgusting and difficult to stomach is the fact that I was upgraded in 2003 (they could have upgraded me to the moon and I'd had no clue!!). I have no idea why this happened as obviously I was not aware of the policy in the first place. How can it be legal and right that changes are made and then I am expected to respond retrospectivley!! I really must polish my crystal ball harder!!!!
I also am angry that GE cancelled the policy again without my consent - I know I was complaining about the PPI but I may have wanted to shop for a cheaper policy elsewhere before loosing cover- now I'm unemployed and and can't claim either. But I can always act retrospectivley and reactivate it!!! To me this is syptematic of the way this policy has been handled from the start. Make a change without consent and then say -"well you had 30 days to cancel it" - BUT YOU HAVE TO KNOW FIRST!!!!!!
It also makes me angry as I was out of work last year for 3months and didnt claim as I didn't know I could. Do GE really think if I had known about the policy and its all singing and dancing upgrade, (the benefits of which they listed in their response letter after they had cancelled it) that I wouldn't have claimed then instead of struggling to borrow money from family to keep afloat???
GE are confident that they have the upper hand with me but I will continue as far as I can so any advice please, please moneysavers let me know!!!!!!!!

I understand how frustrating this is for you, I have one or 2 in regards of loan ppi though and the FOS were unable to investigate, and of course this does not help if they were not covered, where they then fob you off thinking you have nowhere else to turn.
if you don't mind me asking, do you know the amount of PPI your paying into this?

I've had it up to the limit of 1500 for some years and the current rate is 1.99 per £100 per month so should add up to a bit over the years!!0

I have just received a standard letter back from Santander re: Dorothy Perkins card. It states that the PPI was not miss sold for the same reasons as above i.e.
-you've signed for it
-there was a 30 day get out guarantee
-it's been shown on your statement since you had the card
-they were under no obligation to record the sales process on 21st September 2001
They have then referred me to the FLA is dissatisfied. I've read another post today that said the FOS would still potentially take on these compliants, has anyone come across this?

People are saying that FOS is actually reviewing all complaints for PPI but I have not actually seen any evidence as yet to say that an outside of jurisdiction complaint can be looked into although it may be best to actually ring them and ask.Has there been any update on the above?

I have emailed the FOS asking them to clarify their position on this and will post the reply as it seems that there are many people looking into PPI claims dating back to this time.0
