proving that something was / wasn't said isn't for 'your own use though'.0

Were did you learn this law?
It IS illegal - although the CPS will not act on it if you have simply recorded a conversation - but if you have recorded it then tried to use it for your own benefit you could be prosecuted.
Why do you think CCTV is recorded without sound?

Your extracts of the TSL and SPL and guidance are of course accurate. Recording calls without informing callers is a breach of the licence. There are two schools of legal thought. If you breach the licence OFTEL could under S16 of the T Act make an order against you requring you to comply. Failure to then comply could lead to civil action by the damaged party or by OFTEL themselves.
The second school of thought says that failure to comply with the class licence means that you are running an unlicensed system, which is a criminal offence under the T Act, fine UKP5000.
In practice, you are more likely to get a warning letter from my staff, reminding you of your obligations.Treat others as you would like to be treated :A0 -

I hope you get diarhoea today.
If you could spell it properly, it could happen!! :rotfl:
My point is that if someone is doing wrong then it is really disgusting if they can get out of it on a technicality. You're like those people who think that we should be warned when speed cameras are around.
SOrry, didn't mean to come across so harsh, thanks for yer advice, and I will bear that in mind if I do go ahead and record conversations. I may set up a multi-option choice menu on my phone system with loads of options and a thing at the end saying "calls may be recorded". Not my fault if someone doesn't wait till the end of the message is it??
Is that illegal or not? 0 -
Zinc Oxide whats with the big type we are able to @@ thank you.
Perhaps you better tell these people they are giving out duff info then.(Although i doubt they are)

No, no, you must give the message at the start of the call. But providing that you don't intend to share the contents with any third party, then you need give no mention that recording is taking place.0 -

Hardly any companies I ever call bother to let people know calls are recorded but instead hide a message at the very end of their menu options. When people choose an option they don't hear the message. Therefore most companies are actually breaking civil law  Am I correct?0 -

Update
Just one more hour till the end of today, and still no sign of diahorrea.
:D:D
You were wrong!! :rotfl:0 -
MY understanding is that if anyone wants to use a recorded conversation in a court of law they have to seek the other person's permission - of course, this will rarely be forthcoming, esp. if they incriminate themselves
