Repair centre lost mobile phone

To cut a long story short we posted a mobile phone on the 15th of January. According to the repair centre and mobile provider the handset was not received. After spending 2 months chasing Royal Mail they finally confirmed that the handset had been signed for at the repair centre.
Spoke to the repair centre who said they'd send a new handset. After waiting a week rang them today to ask where the replacement handset was and we were told they didn't have them in stock, the handset was discontinued and when they could locate one they would send it out. Then spent a further 2 hours onto the mobile provider with no success.
Any advice on what to do. Have had to purchase another handset in order to use the sim card. Been without the original handset for nearly three months.

They have confirmed they received it, so they are liable for losing it. I don't think under the general T&C's they have to provide an identical handset, (this may not be possible if for example it is an old or rare phone), but they should provide an equivalent or better one. Since you have already replaced it, I would ask them for monetary compensation instead. Give them in writing 7 days to do this-not unreasonable after waiting 3 months.No free lunch, and no free laptop0
