It doesn't happen much but it should.

I've amended your quote to even more how it ought to be :p

Someone posted on the families and relationships board to say that this had happened to them (an ex-PWC) obviously she felt it was the wrong decision but it does seem this is more likely to happen than previously. Unfortunately I can't remember the username and it was within a thread rather than it's own thread.

    Good luck everyone

    Blob,

I know for a fact that my OH desperately wants to see his kids, I didn't know him when he was first seperated from them but he told me last night he tried contact centres, going to court ect. But he hadn't heard about this DCO, and neither had I until doing some research.
So basically, if he get this contact order and she refuses, my OH can get a penal notice on it which means what? that she has no choice but to let him see them? sorry for all the questions but really want to help him if I can as now he's with me he feels so much more confident.

My understanding of it means that once you have a Penal Order attached to a Contact Order and it is then broken you can apply for the other party to be sent to prison for Contempt of Court. If this happens then you will be granted a Residency Order as someone has to look after the kids.

If you wna to go down this rout then please talk to a solicitor to make sure that I have got it correct. I know up to and including applying for the Penal Order from first hand experiance the rest is what I remember being told!

Thank you for this, its really helped, will see what I can do about getting a solicitor. Do you know the costs involved at all? I cant put a price on my OH's happiness but its just to give me a rough idea?

Did things work out for you? Do you see your children on a regular basis now? Hope you don't mind me asking.

As said a solicitor is not always needed/best advised. They tend to prolong proceedings for their own benefit.
