Joint Account - is this right?

Hi,

My OH is in the middle of divorcing his wife. They have a joint account and he recently opened an individual account with the same bank. As she has internet banking she has been able to transfer all the money out of his new individual account into the joint account and then out to her own account, essentially stealing it from him.

My question is, is this reasonable? I would have thought that the individual accounts would not be accessible by another party, even if they share a joint account with the holder. Does he have any right to demand the money back from the bank as they shouldn't have let her take it in the first place?

    I have the same system. me and my husband have a joint account but i have an individual account also but i can see all accounts thru online banking and also transfering money from the joint account is quick and easy. My husband thinks this is unfair, i guess it is if i was in his position. Your partner should get in touch with the bank asap, to remove all access. But he may need his wifes permission.

    He shouldn't need her permission regarding his account - which is exactly that - his account.

    The bank shouldn't have moved the money.

    My H and I have 2 joint accounts and an account each with the same bank, I can see mine and the 2 joint accounts but not his and he cant see my account

    That shouldnt be possible!

    It sounds to me as if she had his internet banking ID & password.

    I can only see our joint account on my log on, but my husband can see both the joint account and his own account (held with same bank) on his log on.

  • Crikey surely that's not allowed?! I have a joint ac at HBOS who my OH also banks with. I bank with RBs though. Sound like she has login details as surely she cant siphon money out his personal account?! Crazy! Could she be done for stealing??

    I would get your OH to get onto the bank asap and get advice. and perhaps get him to set up an account with another bank totally separate to the joint ac.

    Ive got a joint account and a single account with Nationwide, partner can see both accounts with his login details. When i was getting divorced my solicitor told me i could empty my joint account if i so wished as the money was mine too. In this case as it was your partners own account i would definately get advice on it. Good luck

    We mainly bank with Nationwide - it's always myself who checks the online banking and it's in my name. My OH and myself share joint accounts and I have my own account. We both have ISAs. As the internet banking was set up in my name, although I can see my ISA, I can't see the one belonging to OH. That account would be shown on his screen only, if he decided to join the 21st century and started online banking!

    No-one other than the person who set up the internet banking should be able to see other accounts. Your OH should complain to the bank as his own private account should not have been accessible to anyone other than himself.

    The bank is unlikely to help if she had his internet banking details - they'll argue that he was negligent in letting her find them out.

    If you banks are allowing this ask them why this is happening what is causing the link that allows a third party access to your personal accounts.

    You NEED to know why this happens.

    If they can't do anything about it change banks.

    Barclays manage to keep our personal accounts seperate and we both have access to the joint ones.
