6. The closing date for all entries into the DH Prize Draw is 11.59pm on Saturday 18th April 2009.
Picking the winners
7. The winners of the DH Prize Draw will be the first 20 entries drawn at random from all eligible entries.
Publishing details of the winners
8. GNM may publish the name and county of all Prize winners on www.observer.co.uk/seethelight and may use winners' names for promotional purposes. By entering the DH Prize Draw you give us permission to use your details in this manner. The winners may be required to take part in other promotional activity with GNM.
The Prizes
9. 20 winners will each receive a signed lithograph print (420 mm x 840 mm, portrait) of the Damien Hirst painting known as "Beautiful, Father Time, Hypnotic, Exploding Vortex, The Hours Painting" (the ("Prize" or "Prizes").
10. The winners will be notified by email within 15 days of the closing date. If a winner has not accepted their prize within 7 days of notification, GNM will re-draw and select a new winner (and the same acceptance period will apply).
11. In order to receive their Prize, winners will be required to provide further personal data including their full name and a UK address for delivery of their Prize.
12. GNM will use all reasonable efforts to ensure that the Prizes are received by the winners within 28 days of receipt by GNM from the winner of their name and address for delivery of the Prize.
13. The Prizes are non-exchangeable, non-transferable, and are not redeemable for cash or other prizes. GNM accepts no responsibility for any costs associated with the Prizes and not specifically included in the Prizes, including any insurance for the Prizes (for which winners are responsible).
14. GNM reserves the right to substitute the Prizes with other prizes of similar value in the event the original prizes offered are not available.
Copyright in the Prizes
15. Damien Hirst ("the Artist") owns all copyright in the painting known as "Beautiful, Father Time, Hypnotic, Exploding Vortex, The Hours Painting" and in the Prizes and will continue to do so even after a winner has won a Prize. Prize winners must not reproduce all or any part of the Prize in any format/medium, unless they have permission from the Artist to do so.
16. Prize winners should note that the Artist's Resale Right Regulations 2006 ("the Regulations") may apply when a winner sells or otherwise transfers ownership of the Prize to a third party. If the Regulations apply, the winner will be required to pay a royalty to the Artist. Winners are responsible for paying this royalty and should obtain independent legal advice about the Regulations, and GNM accepts no responsibility to prize winners in this respect. Prize winners acknowledge that their failure to comply with the Regulations may cause GNM damage or loss and winners agree to indemnify GNM in full and permanently against any third party liabilities, claims, costs, loss or damage GNM incurs as a result of such failure.
17. Evidence that the painting known as "Beautiful, Father Time, Hypnotic, Exploding Vortex, The Hours Painting" is an original artwork by the Artist is contained in the video showing the creation of the painting by the Artist on www.observer.co.uk/seethelight. The Prizes are lithograph prints of this painting. On the basis that GNM has provided this audio visual record as the sole evidence of the painting's authenticity, GNM accepts no responsibility whatsoever towards Prize winners in relation to the legal authenticity of the painting and/or the Prizes.
Some other rules
18. GNM may use contractors in connection with the running of the microsite located at www.observer.co.uk/seethelight and associated services (for example hosting providers). They are only able to process data on our behalf and in accordance with our instructions and not for any independent purpose.
19. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
20. GNM takes no responsibility for entries that are lost, delayed, misdirected, incomplete or which cannot be entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
21. Details of the Prize winners can be obtained by sending a stamped addressed envelope to the Marketing Department (marked "DH Prize Draw winners") of the promoter: Guardian News & Media Limited, Kings Place, 90 York Way, London N1 9GU.
22. Entry into the DH Prize Draw is free (although you should note that normal internet connection charges will apply).
23. Nothing in these Terms and Conditions shall exclude the liability of GNM for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
24. GNM accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the DH Prize Draw or accepting a Prize. GNM further disclaims liability for any injury or damage to you or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the DH Prize Draw.
25. GNM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the DH Prize Draw:
a. with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud).
b. on reasonable prior notice for any reason.
The decision of GNM in all matters under its control is final and binding.
26. GNM shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
27. The DH Prize Draw shall be governed by English law.

Win the original Damien Hirst painting created for The Hours' album cover
The spectacular and strange relationship between art and music is celebrated in a special issue of the Observer Music Monthly, starring Damien Hirst and The Hours on Sunday 19 April.
From John Lennon and Pete Townshend to MIA and Florence and The Machine, ex-art school students have been crucial to the history of British pop; and from Richard Hamilton and Peter Blake to Banksy, the number of artists who've collaborated with their favourite musicians is legion.
Now Damien Hirst, the most successful British artist of his generation, is working with his friends in the band The Hours: designing their record sleeves, art directing their videos and releasing their new album, See The Light, on his own specially-created label.
You must register your details below for the chance to win one of 20 signed litho prints of the Damien Hirst artwork created especially for The Hours new album sleeve. Then, on Sunday 19 April in Observer Music Monthly magazine we'll reveal what you have to do to enter the competition to win the original artwork – valued at £125,000 – created by Damien himself. Everyone who registers will also get the chance to exclusively download the track These Days from The Hours' new album See The Light. To see Damien creating his painting, see the video to the right.
Good luck and we'll see you on 19 April.0 -
