Sould son resign and if so would he get benefits? Help

Ok im hoping someone can help me with some info for my son.

His story so far:

Ok well my poor son has been ill for along time now and has been making the best of it.(He is just 27) But a few weeks ago he got so bad he had to take around 8 weeks off work and was having all sorts of tests done to him some not very nice (He had very bad lower back pain, bad pain in his abdomen, sickness and was always very weak)

He did his best and went back to work hoping he could make do with the painkillers and meds he was taking. Sadly they didnt help him due to his work (He is always on his feet, rushing around having to go up and down ladders lifting havey goods) So was in pain every min of the day and having to take to his bed for a few hours after work in the hope it would settle the pain.

So as a reslut his doctor signed him off again for 6 weeks (Also told him to try and find a desk job where he could sit all day) He found out on monday that he has a curviture of the spine and IBS. Which now explains why he has been so ill. The doctor has him on meds to try and settle it as he waits to see the specialists.


(Also he was knocked from a ten foot high ladder at work by falling stock landing on his back. He is not sueing before anyone thinks that and has no plans to)

so what im wondering is

seen the doctor thinks this job does not suit anymore and that he needs a desk job. Sould he resign on medical grounds to he can find the right kind of job?

Also

If he did would he get any benefits due to the reason for resigning?

Im worrying sick about him.

    HI,
    i understand where you are coming from as my hubby has ibs and is sick and in so much pain from it and with your son having the spine problem too it must be awful.
    just a suggestion: maybe he should continue to get signed off work rather than resign then eventually his employers would part company with him and it may put him in better stead for esa (used to be incapacity benefit) and dla.

    As for being knocked off the ladder by falling stock, was this ever entered into the accident book? It needs to be reported to the Health & Safety person at work at the very least.

    It would be better for him to continue to be signed off by his GP and eventually the employer will either make changes to his job whereby he is deskbound (he can ask for this as a reasonable adjustment) or pay him off. Best to stay off sick.

    Yes the ladder thing was reported that same day and filed by a manager.

    They wrote to him this morning looking to see his medical file

    Hi there, I am in a similar position. I am giving up work to focus on improving my health as I have a long term condition. I'm not ready to be permanently signed off as I hope that I will improve again if I take some time out, although I know this might not happen. The Job Centre advised that I can claim contributions based ESA because I have been in work for ten years and should have paid enough NI.Apparently you don't have to be retired from work on ill health grounds. I was advised I can still claim if I just give in my notice. Sounds a bit too easy to me though!

    There are no sanctions for leaving work early. On ESA that is. If your sick your sick.

    I dont see the harm in keeping the job open though if the condition does improve.

    You said that he had no plans to do anything about being knocked off a ladder in case you were going to get slated on here, far from it. If he was knocked off a ladder then he should be doing something about it. Like another poster said it should at least be down in the accident book, and i would at least have a few words with a solicitor, one which will give you half an hours free time. Go for it, nobody would blame him.

    If it was not his fault he could get a fortune in compensation.

    Thanks so much to everyone that has got back to me. Its so nice to know there is nice guys/girls willing to help with some info on this.

    It just upsets me that my son is dealing with so much at his age and im 54 and doing the best sould be other way round. I tryed saying to him ages ago about the ladder fall as it was down to poor stacking of stock and his back did really kick in big time around that time. But said he would not do that as he loves the job (been there 5 years in oct) and didnt want the management getting it in the neck.

    Its driving him mad being at home has he worked fromhe was 14 after school and has never been out of work.

    But i dont see any hope for him going back there when the doctor is saying to get a desk job. Dont know what to do for best

    I just hope your getting the help you also need. As it cant be easy having to give up work when its all you know. I can understand its hard seeing what its doing to my son. Just hope you get much better real soon
