Employers ignoring me & my appeal

Awhile back I was dismissed for gross misconduct, something that ultimately was unfair dismissal and held no substance. I have went through the process of Appeal and lodging a Grievance. I have been waiting for a response about a month and have yet to receive anything. I have contacted them via email the last week and it seems like they are ignoring me. What should I do? Thanks for any advice.

    Hi

You give too little information to offer advice. Can you answer these questions?

    1) How long did you work for the company?
    2) What was the incident that lead to dismissal through misconduct?
    3) Did you follow the internal appeal procedure? If so what was the outcome and the reasons?
    4) What do you want as a outcome?
    5) How long as it been since you appealed the dismissal?

People will find it hard to help you without answers to the above.

    Thanks
    Bozo
  • 1. I worked for the company 1 year 5 months.
    2. The matter was Health & Safety and something I wasn't trained about. I also had a list of fabricated items. Essentially I have been set upon.
    3. I followed the Appeal procedure and have not received any outcome.
    4. I want them to acknowledge that they are at fault and say sorry. Is that a valid reason?

    what do you think?

do you want your job back, or any compensation?

might be worth a call /visit to the CAB (not VAB, doh!), to see if they can nudge then along..
Long time away from MSE, been dealing real life stuff..

  • Unfortunately I'm not in a union. I did speak to an employment solicitor who didn't understand why this particular Health & Safety incident in question was my fault. This particular company seems to use Health & Safety as a mean to get rid of employees, which I have evidence about.

What's VAB? Yeah to get my loss of earnings from the time I have been off, would be fair.

They have also not followed their own procedures regarding time and other things.

My advice is to find a union and join. You'll get legal advice as well as support on your case. What's your type of work?

NB I suspect Brightonman meant CAB. V is right by C on the keyboard.

Can you elaborate on point 2)

What happened? What were you not trained on? What were the consequences?

I'm not sure if thus is true for all unions, but my union can only represent and advise you in disputes that occur before you join
