Gateshead Single Yellow Lines

I kindly ask for help.

I have recently had the misfortune to receive a parking ticket while parked on the verge well behind a single yellow line to the side of an entrance that goes to nowhere (one of the things that gets put in when a new development is being built. Earth is piled right across this entrance and the yellow lines disappear underneath). I have been back there today and have noted that the single line near where the car was parked does not have a T bar end section and the line is broken around a gully (no line on the top of the gully and it is missing by 25mm on one side and 85 mm on the other) in the same area. The yellow line does not, have a T bar on the other side of the entrance either which continues down the road. The length between this entance and the next and hence the length of the yellow line is 73m 100mm, and there is only one sign which is 47m 600mm from the end where the car was parked and the end where there is no T bar stop end.

The questions I have are:-

1. Does the yellow line definitely need a T bar stop end even though the line disappears under the earth bank.
2. Does the yellow line apply even though the car was parked on a verge. There is a yellow waiting prohibited sign 47m 600mm away.
3. Does the ticket apply when there is a gap in the yellow line, like I have desribed around the gully.
4. Does the yellow line with a length of 73m 100mm need two parking restriction signs.
5. Because the line does not have a T bar end and neither does the one at the other side of the entrance, can it be taken that the line is continous from one side of the entrance to another.
6. Does the fact the end of the lines are covered by the earth bank make a difference to the ticket.
7. If the answer to question 6 is yes, is a distance between signs of 75m 760mm too much.

I do have multiple measurements and photos if they are needed.

I am new to this and and having remained clear of tickets from a driving history of 22 years I would really appreciate help that anyone can give.

  • Can someone please help me as I have been trying to create a message with the relevant info of pictures and a scan of the ticket I received as requested. I have followed the instructions in the guide and tried putting in the address of the pictures on tiny pics and that would not work. Then I tried getting rid of these addresses and copying the pictures directly into the message. Every time I tried to preview the message it said that I could not upload as I am a new user and it takes the addresses and pictures as potential spam. Quite frankly I am at a loss as to what to do.

    what does a yellow line mean?
    what does that clearly posted and marked sign say?

    if a double yellow was under snow, would you use the same excuse?

    It's not a 'technicality'. The authorities have rules they must abide by too. And if they don't, then they cannot enforce their own rules on the driver. That's reasonable, isn't it?
  • To be honest I'm not convinced the yellow line measurements or condition will assist you as the common criteria used by an adjudicator will be whether the condition of the line is sufficient to reasonably convey the restriction.

    However, there are other avenues to explore.

    I suggest you request a complete copy of the Traffic Regulation Order (TRO) that enables the enforcement of that section of single yellow line. If it's not listed correctly then it will be unenforceable. When you get the TRO check through the exemptions as you may have been parked for a purpose where an exemption applies.

    Request a copy of all photos taken and a copy of the CEO's log book entry. The CEO may have made some simple errors such as wrong location, vrm etc. If so this will be in your favour.

    It seems to me that you were parked in a location where one road meets another. It is important you establish exactly whether the verge belongs to the road named on the PCN or comes under the other road. If the verge is considered part of the other road (not the one on the PCN) then the wrong location has been put on the PCN making it invalid.
