advice please... stepson sold dodgy motor.

wondering if anyone had any advice on what to do in this situation.
my stepson bought a car at the end of dec for his 18th birthday out of money given to him.
his dad (my oh) went with him to look at the car and although it wasnt to oh,s taste , his son had his heart set on it. oh asked specifically if it had been involved in any accidents and was told it hadnt.
they bought it then took it home. his son was till taking driving lessons and passed his test this week so got all the ins tax etc sorted out in the process finding out it was accident damaged so the ins on it is sky high :confused:
he wanted to take it out today after eventually getting ins as he planned to come and see his dad and baby sister driving in his car for his first proper adventure bless him.
well he was driving along and he heard a noise so pulled over luckily just in time as the wheel fell off:eek: it apparently wasnt bolted on properly and the bloke who helped him fix it told him something else was wrong also with it.

my chap phoned the garage obviously distressed s his son could have been killed but the bloke wasnt much help at all saying it was nought to do with them.

obviously it has been some time since the car was purchased but it hasnt been driven in that time...does the garage have any legal obligation for 1. selling an accident damaged car without telling them it was one and b. one that was obviously dangerous to drive as not even fixed safely:confused:

if anyone has any helpfull advice we would love to hear please as poor stepson is now obviously a bit shaken up by the whole experience today and oh is angry with the garage and i feel a sorry for stepson as he is a good lad and was so prous to get his little motor and only wanted to come and see his dad and sister bless him and its all gone t*ts up to say the least:rolleyes:

  • i think you are wasting your time with the garage, end of dec was 3 months ago, how do you know someone has not fiddled with it in the mean time?

    Someone tried nicking my alloy wheels as i found out when i tried to move the caar!
  • If you speak to the Citizens Advice I am pretty sure they will tell you it is down to the garage to prove that any faults on the car were not there when they sold it - apart from normal wear & tear. This is for up to 6 months after they sold it.

    Although you have bought from a trader, 3 months is far too long for the dealer to be interested. If he was interested in the car he has had that time to check it out throughly and get is all ready for the road.

    Caveat Emptor i'm afraid on this one.

    Don't think you have any comeback regarding the wheel.

    As for it being involved in an accident, the trader is obliged by law to tell someone if a car has been involved in an accident and your stepson will be covered under the Sale Of Goods Act I assume.

    Has a HPi check been done to find out what and when the damage was?

    You should go back to the dealer about the accident damage. If you specifically asked the question, the dealer should do something now because he should have answer honestly. even if he didn't know I think you should be able to get something back from him now. Accident damaged cars once repaired are usually worth about 20%-25% less, so ask for 25% of the sale price back.

    if the dealer didnt know then he didnt know,when he got the car he would of had it with the old logbook not listing damage,it only updates when the book is sent to swansea to update new owner etc

  • to be fair, i doubt any dealer with a brain (no jokes) would knowingly try to flog on a car they knew had been in a smack, too much hastle

    then again, ive heard some horror stories!
  • hi thanks for the replies...it didnt have the logbook with it as dealer said it was lost..one of other resons oh didnt want his son to have it but son wouldnt listen as too excited in getting his car:rolleyes:

    i said the same thing about dealer will say it can have been tampered with regarding the wheel as it managed to drive to the house and didnt fall off then(it hasnt but pretty hard to prove:confused: )
    i will tell them citizen advice way to go as he lied about it being accident damaged and without the logbook it wasnt something they could check upon either at that time.

    hopefully a chat to the citizen advice will be fruitfull then but what is the hope of the dealer listening to them:rolleyes:

    in what way:confused:
    if a car is sold illegally ie not saying it was accident damaged which it was then surely you can expect to be compensated...especially seeing as it hasnt even got the wheels bolted on:eek:
