You are living in a dream world if you actually believe that you are going to not only prove that damage to your vehicle is solely caused by speed humps, and if you are actually under the illusion that you will get compensation then i wish you luck. Dont hold your breath though0 -

Just wait. I've already had a reply from Honest John about his campaign and his work with the Transport Research Laboratory. It looks promising. I'm not holding my breath but I will fight for justice and the truth. What kind of person are you if you just 'assume' that nothing will be done purely because nobody's ever got compensation from them before? I call people like you pessimists. :rotfl:

Call me whatever takes your fancy, i call people like you dreamers who are always after something for nothing but there you go. If your car needs a bit of work pay for it to be done and get over it instead of trying to find someone or something to blame.
If you dont like opinions then dont post on public forums and ask for them. What did you expect? Everyone to bow down to you and egg you on? Start a rally or something? I gave you an opinion that you dont agree with, thats all. There is no need to start going on at me about how i shouldnt be here etc.0 -
Back to the pot hole question. If you knew the pot hole was there or if it was so large that you would reasonably notice then your claim against the council would fail as you have a duty of care to yourself.
As another poster mentioned you need to see the inspection reports, if you make the request under the Freedom of Information Act then they only have 28 days to provide this information. Also under this act you could ask for details of all pot hole claims made in the last x months for that road, whether they were paid or refused. You might be surprised that the same sort of incidents are paid for some and not others.
PS speed humps are a pain but as a mother I appreciate that they slow traffic down which could save my child's life. I was knocked over by a car aged 15 outside my school. If the speed humps had been there the car would have been moving slower and would have been able to stop. There is such a huge volume of traffic on the roads these days that something has to be done to slow the traffic down. Cameras don't work (only on the few feet by them!), humps do. If you hate the humps so much near your home you could always move house.;)

Every compensation claim paid out by the Council increases your Council tax bill. Eventually they get their money back from you!

If speed humps save a few children from getting knocked down then im willing to pay the slight extra wear and tear on my vehicles to be honest anyway.0

Nobody ever thinks of teaching children not to wander into roads in the first place. I pay my road tax which entitles me to use my road space. Pedestrians should cross at designated crossing points.
In Germany you can get a fixed penalty fine as a pedestrian if you cross anywhere other than a crossing. We should start that here, oh the protests that would ensue! :rotfl:
Nah, I wouldn't move house because of these, annoying as they are, I'd be more likely to hire a JCB and move the humps instead... now there's an idea. It's an idea about as nonsensical as putting the humps there in the first place, but there you go. :rolleyes:
I don't see why we should shell out money on speed humps when we can't find money to repair the holes in our roads. How about using the tarmac earmarked for speed humps and using it to fill potholes? No, that's too logical for some... :rotfl:0 -
I rang a council about something similar a few years ago.
Though the reply to the OP seems illogical, it means in fact that they repaired the road as soon as they were made aware of the problem. To prove negligence and make them liable, you may have to find that they had been already informed of the fault but had failed to act.
I'm not suggesting this is fair, but that will probably be what the case hinges on. I may be not remembering what I was told all those years ago very well, but she certainly told me they would have to check if they already knew about it.0 -
There is no reason whatsoever why you shouldn't get compensation for the damaged wheel and tyre.
A few years back I was driving down a country lane and hit a pothole full of water. It wrecked the tyre and damaged the wheel, even at quite a low speed, due to the size. I got to the office and someone told me that the council actually has a small group of people who do nothing but deal with such claims.
I returned to the scene within the hour to take photos of the hole, and measurements of the length, width and depth. I also noticed that the hole had been ringed with paint. This shows the council have been made aware of it and marked it for repair. Armed with this evidence I contacted the council who sent the forms. I duly completed them, enclosing copies of the photos. They paid for the repair in full, and even paid for the photos.
Sure enough the road was repaired within 2 days, but I already had my evidence! They knew they were liable so paid up. I have since found out that many councils actually find it cheaper to pay these claims and repair the offending potholes, rather than have a proper inspection and repair programme.0
