Unfair Decision Dogging Me For Years

Hello there Martin and all you lovely forum members..
In april 2005 someone made a claim against my policy with Tesco insurance..
I was oblivious to this until I came to renew my policy, when they informed
me that they had paid out against the claim.
My car was a 2003 For2 Smart car.. with plastic panels that are soft and reform, insured at my flat in Bootle....... :eek: pricey!!
The claimer was driving a Mercedes sprinter long-wheelbase van..
He told them I had smashed his rear tail light, something I contested, as it
was physically impossible.. mainly down to size and the height -the light being higher than any point on the smart that could have done any damage , without seriously hurting the smart car as well..
As I had received no damage, made no claim, and been unaware of the claim made against me.. I felt this was unfair.. especially as no attempt was made
to contact me by phone or mail to clarify the situation..
I met a brick wall with the liability dept and eventually gave up and went elsewhere.. having to sign my vehicle over to my partner, and get insured as a
named driver on their policy.. as the quotes I received were extortionate and
based on the alleged accident..
Now some 4 years on and I'm still being overcharged for my car insurance..
I pay £98 a month, with a £600 excess.. but I've never had a motor accident in my life???? plus I'm now living in Somerset.. where a normal quote would be £40-£45 Pcm with £50 excess..
Something is very wrong here.. what can I do?
I have recontacted Tesco's and they have my details on record,
The girl I spoke to seemed to think that the details presented by their system
contradicted themselves, indicating an error or definite problem..
I've been given the number of the Liabilities section again to call tomorrow..
I know they will palm me off again.. huge wet flannel in the face.. the computer says no.. etc..
SO .. where do I go from there?
Without this false judgement, I am owed years of NC bonus.. and have thus been missold policies since, and presumably am owed hundreds..

Help? pretty please? You've helped lots of people I know, If you can't help
I don't know who can....:confused:

    I'm not sure I agree with this at all. Tough luck with the handling of the claim, but IMO it was not really the right call to change the policyholder to your partner, considering the long-term implications. If you had kept it in your name, assuming you had a maximum NCD before the accident and have been claim-free since, you would now be back at maximum NCD and not even having to declare the accident to insurers who only ask for a 3 year claim history.

    I'm not really sure how you've been 'mis-sold' any policies either?
  • You're due nothing

    You have paid premiums based on your history and this is correct.

    You could have contested the case more at the time and possibly won but given you are years down the line even if you do sucessfully appeal you won't be able to claim cash back because you were too lazy to do that earlier.

    I also would suggest one minor claim would not have the sort of adverse effect you claim for so long.

    Not that I intend to reclaim this, but I would at least like my noclaims back..
    Can I appeal to an Ombudsman if/when they flannel me?
    And I wasn't being Lazy.. I just hit a brick wall with liability, mainly as they had already paid out on the claim.. so I turned my back on them in disgust..
    I simply could not afford the higher cost as a result, and was forced to create
    a workaround as a named driver..
    I would agree that this should not still affect me, and this was the main drive
    of the stupidly long phone calls I've made this evening in an attempt to be heard..

    You can however I doubt you will get more no claims back, maybe what you had at that time and if its over 2 years old its unlikely to be accepted by people.

    Ultimately if you were that bothered you should have chased it before now.

    ah, yes, I would have ,but I've only gleaned this information tonight..
    I have never mentioned it on any forms or applications, so I presume it must
    be passed from insurer to insurer??? I've always wondered why my insurance was high.. I just put it down to living in Liverpool..
    Now I'm in uberquietsville - Somerset, I can see the contrast to my local friends policies..

    They weren't 'mis-sold' at all. You gave them information. They provided you with a quotation. You accepted it. The decision of the previous insurer is not the fault of your subsequent insurers.

    Pointless, I'm afraid. Even if you did succeed, you would only end up with reinstated bonus which is obsolete anyway - I don't know of any motor insurer that will accept bonus that has not actually been used on a policy for 4 years.

    There must be an issue however as it was over three years ago, and it still affects me??? surely thats not right?
    Tomorrow will glean more info anyway..
    I'll post up what happens.. but I'm not too sure it will be positive.. :(

    Why so worried?

    Named drivers on other peoples' policies are welcomed by the insurers, not just accused of committing fraud.
