Liquid gas

Hi
Right this is going to be my last post here for today honest. My Father moved and put his house up for sale as he lived not on the main road he had a liquid gas tank fitted for his central heating and although a little expensive everything was fine for the years he had it. while his house was empty and for sale he used to keep the heating on to keep the house aired as he called it but then he ran out of gas so he ordered 750 litres for the tank but shell came and put 1500 litres in and then when they realised they billed him for the other 750litres and pestered him threatend him with court but he stuck by his guns saying "no I
didnt order 1500 only 750 litres" then they offered him to pay so much a month and he said come and take the excess gas out they declined saying they can't remove it from the tank. Then they accepted defeat We Think and said they would bill the new owners but the new owners said they can whistle for it. Now he is starting to worry about them chasing him again he is 82 and doesn't need this hassle. The tank is his he bought the tank so he wasn't tied to a contract with a perticular firm and could shop around. What do you people think about this mess?

I think he's done the right thing, it is Shell's fault after all, he ordered 750, they gave him 1500. He gave them the opportunity to remove the product but they declined.
Therefore it is Shell's own fault and they should accept the loss.0 -
So,how much money are we talking about?
Is any of this in writing?EG the order.0 -

What was your fathers agreement with Shell?
I suspect he will be chased again and likely have to pay for it.0 -
No he won't have to pay for it.
If I ordered a TV and 2 turned up and I gave the retailer the opportunity to collect, they could hardly claim the price of 2 units.0 -

do you mean "unjust" enrichment? What relevance does that have to this case.
Unjust enrichment is not a contractual or tortious right so cannot form the basis of a claim.
The OP's father did not contract for the extra gas and so is not liable to pay for it.0 -

Its very different.
firstly there is likely to be some ongoing contract/account for liquid gas, secondly the gas is going to be used - a 2nd Tv could be left in the box - thus as soon as someone uses the gas money becomes owed.
I would be very surprised if the OP's grandfather didnt sign some sort of agreement before deliveries

Nope there is no ongoing account with Shell my Father owns/owned the tank and all the pipework so he could just order from who and as much as he liked, its like a Free House they can buy the beer from anywhere and he would just phone the order in.
