OK so letter has been sent along with the N245 and a £35 cheque that I had to cadge off my dad!! They recieved it today and I called to confirm. The lady now says its being transferred to my local court for a hearing!!!! !!!!!!!!! How many times do I have to tell them!!!!! I can only afford £8 per month, which is even more than a £5k debt gets!!
    I'm worried!

You've nothing to worry about gert, providing you can prove via an I&E £8.00 is all you can afford, the court should accept that.

It's a redetermination hearing, a decision will be made on the amount you must pay each month, routine court hearing procedure, you've nothing to worry about ;)

But they will take into consideration our circs and SOA etc?? Do they take along time and will I have to say anything? I'm really really nervous!! More nervous thanwhen we went to court to have the charge on the house put on!

    Gert

The judge will look at your I&E, and will make a decision what s/he is reasonable to both you and the claimant, the ruling is not going to leave you begging on the streets.

Please, try not to get to stressed, it's a straight forward procedure.

If, and it's a huge if, things go against you, there is an appeals procedure you can instigate should you have grounds.

Well, just in case anyone was interested in how the redeterminationhearing went.....I wish I hadn't took OH!! I would have gone in and let the judge decide rather than let the claimant 'blackmail' us into paying £30 per month!! He threatened us with bankruptcy and OH crumbled at that!! With his job, he can't be declared bankrupt! After we went in to the court room, with the judge, I believe he was going to grant us the redtermination of £8 per month, but oh well.!!

I'm confuddled now too as the cliamant has sent my a standing order form x 4....one copy for me, one for my bank and two copies for him. He wants my bank details and sort code etc and I'm not happy about that at all!! I set all my S/Os up via internet banking and so don't see why he would need my account details etc - if he has those, could he not take more money than allocated to him??
