Trying to fill in Court papers N9A - Any helpers??

Hi all
I'm trying to fill in court papers that landed on my door yesterday with a posting date of 10/03/09!!!
Only have 14 days from postmark to fill in which means they have to be back by 24th which is Tuesday!!
They are papers to secure payment of the Home Information pack we took out last feb when the house went on the market....plan was to pay the HIP when the house sold (house is still on the market - another story).
Anyone, my question is is the HIP a priority debt as we are still 'using' the product or is it classed as non-priority and therefore the suggested payment should be prorata with my other debts??
Thanks

Firstly you need to make them aware that you only received these papers today!!!!!
...Linda xxIt's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.
We dont count all the runners ahead of us & feel intimidated.
Instead we look back proudly at our journey, our personal struggle & determination & remember that there are those that never even attempt to reach the starting line.0 -
I got them yesterday but today is Saturday - no-one is going to be open?!?! How can I get in touch?
I knew they were coming cos I called the creditor to offer payments which they declined stating that papers were on the way - that was Tuesday.Made it - 15 years married!! Finally!! xx:beer:0 -
I think, if you are planning to defend the claim you can return the acknowledgement or something and then it gives you another couple of weeks to sort it out.
pm 10past6 - i'm sure you will get some help then from someone who knows their onions!

I'm not planning on defending the claim - I know I owe the money and I know I have to pay it. Was just silly to think that house would sell within the 9 months - or saved up!! But the hindsight is a wonderful thing!!
Will PM as suggested thanks.Made it - 15 years married!! Finally!! xx:beer:0 -
Hi gert
Who is the claimant re the HIP?Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -

My understanding Gert, it's not a priority debt, have a read of the T&Cs and see which part they claim you've breached in bringing this claimgerturdeanna wrote: »Countrywide Estate Agents T/A Bairstow Eves

I should imagine the part they are claiming I've breached in that I've not paid them in December when I should have!!
Thanks for the advice - they can have the same as everyone else prorataed!!
On the N9A, there is only sections for things like Mortgage, Gas, electric and housekeeping where as CCCS 'allows' me moeny for hairdressers and clothes etc. Should I just attach a copy of my SOA as collated by CCCS or fill the courts one in and add everything else on to the 'Housekeeping' section??

Send the CCCS one, with a covering letter stating your debts are being paid pro rota via CCCS as per the attached document.gerturdeanna wrote: »Should I just attach a copy of my SOA as collated by CCCS or fill the courts one in and add everything else on to the 'Housekeeping' section??Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

I've only just asked CCCS for help - I have previously been with the CAB but was 'released' to self manage last year.
I'm hoping I can get us on to a DMP with CCCS because my understanding then is that I pay x amount to cccs and they pay to my creditors??
I've just had baliffs knocking on Friday because I forget to set up a S/O and I can't go through that again!!!
I do have about 14 creditors and owe over £30k......£24k of which is secured against the house - hence why we were trying to sell when market was high....missed it though (Story of my life!!)Made it - 15 years married!! Finally!! xx:beer:0
