Tulip UK Cashback......

Well guys, don't fall off your chairs or anything but..... yesterday I received a cheque from Tulip UK for my cashback promotion. OK, 8 weeks later than promised I grant you, but it is here - I have to cash it yet though so won't hold my breath until I have the money.

Do you think that they read these boards as I had already mentioned I would go through small claims when my next month is due and get both lots of money due. My bill is due to arrive any day now and I would have been sending the letter threatening court action within 14 days. Seems a little suss to me, I think someone must have done the same thing or they have realised not a leg to stand on in small claims court and are frantically trying to catch up with the money they owe.

Anyway, it is here so I'll post again when the cheque has actually cleared!!

    I also had to do similar thing to get my first cashback (I got cheque after 8 weeks) and I am waiting bill for claiming my second cashback.

    Few of my friends have not been paid anything.....at all by Tulipplus...
  • I would personally tell them to do the same thing. They cannot get out of it if they still have their intoductory letter as it states what is due to them at what times. It costs £30 through small claims and you get that back so it has to be worth it. I would tell them that if they are waiting their first payment, when they claim their 2nd to write giving them 14 days to pay or they'll seek money through courts. If they are waiting for more than the first lot of money I would tell them to send a letter ASAP telling them they have 14 days to pay up or else. As long as they have the letter Tulip would be forced to pay by the court. Makes sense really - it is about time we consumers started standing up for ourselves - I got stung by my last contractor (letter late on the post, blah, blah) that will NOT happen to me or hubby again!!

    Hi all,

    I have posted before but can't find the advice I was given (sorry).

    I am with the dreaded Tulip and last month gave them 28 days by letter sent recorded delivery to pay me cashback. As I had already been waiting 3 months for my 2nd lot of cashback I sent the letter with the amount I was claiming for (part 2 & 3 and my 'extras' that never got paid). I checked and the letter was delivered on 12/6/06 so the 28 days has expired. In this letter I had told them that if my money was not with me I would take court action to recover the money as I had fulfilled my part of the contract.

    Today is the day that I get it all sorted and will fine with the online Court Claims Service.

    My question is this:
    Is this enough? Would the court see that I had requested the money enough, I sent all the documents they have asked for on time and paid my bills and it quite clearly states they will pay me within 28 days so I should not have to keep on chasing. Is this correct?

    What else can I claim for apart from the money they owe me. I still have the welcome letter specifying the amounts I am due after each period.

    On last thing, a few months back when looking to change my mobile I clicked on this company on Greasypalm called Mobile7 or something. It had a thing on there about claiming a voucher and when the voucher came through it was from Tulip so I avoided. However, their website is still up and running with what appeared to be current phones https://www.tulipplus.com so should this be OK.

    Thanks for any help. I am sick of being stung by these cashback companies and made sure everyone was done just right this time but they are not getting my money if I can hgelp it!! Please advice if you can.

    Hi

    I took the mobile retailer who decided they would rather keep my cashback to court.

    Basically, you should make sure you have a copy in writing of when you should of been paid (probably in their terms and conditions)and the copy of your recorded delivery request giving notice that you intend to collect payment through the court service if they they fail to pay within a reasonable time ( I gave them 14 days).

    Then file a claim with the online court service, 3 things can then happen.
    1. They admit debt and are ordered to pay
    2. They dont respond and are ordered to pay.
    3. They dispute claim,like mine did and it is refered to a court.

    A fair bit of paperwork can be involved, and it can drag out time wise but its worth it!

    Its important to keep records of every letter and recorded delivery slips and records of any phone calls.

    My retailer lied big time to try and get out of paying but the case was heard by post and the court service knew to ask them all the right questions!

    They have to pay the £30.00 court fee as well if they are ordered to pay.

    Good luck, and stick with it, they owe the money so make them pay.....

    Any other advice really welcome.

    I am just about to do this with phones2Udirect. In my case it's a point about Porting which voided the cashback and to add insult, they then charged me full price for the phone!

    The last time I did this on another matter, the judge took a very logical stand, so I won. I think that even if I lose, it's a matter of principal and I'll feel worse if I don't even try!!
  • Sorry, I haven't any advice to add but I do want to wish blue_monkey and JPR the best of luck. I'm not in a similar situation but with several cashback contracts on the go it could easily happen to me so I read with interest other people's experiences.

    mort58: Who was the retailer? How long did the whole court thing take, from initial submission to actually getting the cash (I assume you were succesful)
