Stage 1 letter sent - garage deny wrongdoing.

Hi everybody,

Sorry if this has been covered elsewhere, I'm just really concerned.

I was mis-sold insurance on a finance deal for a car. I've sent the first stage letter as per this website, and the company has rung me up to say that the person who sold it has left and there is no proof I didn't want the insurance.

Is this just scare tactics, and do I go ahead with stage 2 letter?

  • The finance was taken out in September of 2006.
  • I suppose some background might help.

    I bought a car from a Citroen garage on finance, a second hand car. The manager told me that Citroen Financial Services would not provide me with credit unless I took out the Life, Disability and Unemployment cover. My credit rating was/is fine, never been refused credit, never been ill (touch wood), never been unemployed (touch wood). I asked if he was sure, and he said definitely - AND I already have life cover!

    I've just VTed my car to get a new one, and the guy at the new car garage asked what the "Services" fee was on each monthly payment, and I explained it was the Life, Disability and Unemployment cover. He asked why I had it, and I explained how I'd been told I need it, and of course he explained that it was illegal to do so.

    I've paid over £900 so far (30 payments of £30) and even though my car has been VTed, Citroen Financial Services are saying the insurance cover is not eligible for termination. So, I was mis-sold it in the first place, and Citroen Financial Services expect me to pay another £900 over 3 years to pay for Life, Disability and Unemployment cover on a finance agreement I don't even have any more!

    Can anyone spell S-C-R-E-W-E-D!

    Dont profess to know much about these things James but i would feel screwd under these circumstances too. It shouldnt matter whether the man has left, its the garages responsibility, he was selling on behalf of the garage.

    I was told, in no uncertain terms, that I would NOT be given the finance on the car, UNLESS I took out the cover.

    I've printed out the second letter, it's going on Monday. £900 is an extraordinary amount of money for anyone to be conned out of, so I'll be going for their throats on this one.

    "Please contact myself with a suitable time and date when it will be convenient for you to come to the showroom to discuss your concerns in greater depth. Please bring with you all paperork from 2006 as well as your signed finance documents. I am sure we will reach a satisfactory outcome for you."

    This is unexpected, as I thought I would receive either:

    1) a letter claiming no wrongdoing
    2) an offer

    What do I do, do I go in as per the letter, or do I write back saying a meeting is unacceptable, please pay up in full?

    Hi hun

    I remember with one of my cases both myself and hubby were invited to make an appointment with a loan company in regards of a PPI complaint, they wanted to sort this out face to face, in my personal opinion I would not bother, they should have the paperwork and request you want everything in writing, this way you have proof.

    However, its up to you but never trust or guarantee this will be sorted out to the outcome you want.;)

    If you decide not to go, write or ring them and tell them you have received some advice and was advised to keep everything in writing.

    Normally complaints are sorted out by just writing anyway, they may fob you off hun but its entirely up to you.

    Either way good luck, please keep us posted.
