One OP has just posted here.
Her OH has started an IVA - lesser form of Insolvency. They have a joint bank account and he also has a loan in his name only with the bank.
As far as we can work out, the bank used their right to offset to claim the whole value of the loan in his name from the joint account and is now pursuing her for the full cost of the joint OD and his loan.
It is essential that you get that account closed, or get this name off it. Is there any point in the month when the account is in credit?If you've have not made a mistake, you've made nothing0 -
this gets better.... the account has a £1000 overdraft that has not been unused for a year....it only ever has £900 put in to cover mortgage and direct debits, so we are always in overdraft...... HELP0

Although i do pay the loan, as my OH took it out for me as i couldnt get one....but like i say its in his name...confusing i know0

Write to them registered post and tell them that they are not to call you again. All correspondance must be in writing and that if they call you again, you will be reporting them to the relevent authorities.

My mum is very good with us and could possibly borrow us the £1000 to clear the overdraft but no more to clear the existing loan etc....but yes the OD could be cleared as soon as tomorrow really

The loan goes from our joint account but he gets paid into a bank account elsewhere...... what do we do ???0
