    Hi,

    I sent the SAR letters on 15th April 2009 and have as yet not received any replies.

    I stated in the letters that they had 40 days in which to comply with my requests, it's now been around 60 days.

    What should I do now, should I go to the Financial Ombudsman regarding this?

    Any advice greatfully received.

    I would contact the information commissioners office (ICO), they have had more than ample time on this.
    Do you know if they cashed in your £10 cheque or postal order payment for your SAR request?

    And did you post by recorded delivery?;)

    ICO here, I would ring them and not email, because there may be a waiting system.

    this is a data dept, explain your situation to them, that you have not heard after requesting a SAR with payment, and its been 60 days.

    One of the cheques was cashed on 14th May, but I've checked back my statements and the other cheque hasn't.

    I posted them recorded delivery and am sure they both got delivered.

    I don't tend to have much time during the week (Mon-Fri 9am to 5pm) to make calls to places, I don't trust the signal on my mobile to hold out lol, not to keen on making the call from work and I don't get home until after 6pm.

    So I've sent the ICO an online query as attached:

    Dear Sir/Madam

    I have been querying details which appear on my credit report with Experian, so have been in contact with them regarding this.

    I then received replies from Experian concerning two specific entries on my credit report advising that the companies concerned, Tesco Personal Finance and Phoenix Recoveries, thought the information they held on accounts I supposedly had with them was accurate - which I objected to.

    I then wrote the two companies Subject Access Request letters on 15th April 2009 (see attached). I enclosed the statutory maximum fee of £10 and gave them 40 days in which to comply with the request within the letters.

    I have checked back my bank statements and only one of the cheques for £10 has been cashed on 14th May 2009 by Pheonix Recoveries, the other £10 cheque to Tesco Personal Finance has not yet been cashed.

    I have kept all correspondence relating to this and have proof that the letters were delivered by recorded delivery.

    The 40 days I have given both of these companies to comply with my requests has long since expired.

    I would be most grateful if there is any advice/information you could provide to help me with this.

    I got this reply from the ICO today.


    Thank you for your correspondence dated 11/07/09, regarding information held on your credit file.

    Before we can give a substantive response to the matters you raise we need some additional information and would therefore ask you to supply us with proof of the postage of your letters and any further correspondence from the organisations you made requests to, including any chaser letters.

    Please quote the above case reference number in all future correspondence about this matter. Failure to do so may delay the processing of your complaint.

    When we receive these documents your complaint will be assigned to one of our casework teams before being allocated to a case officer who will respond in line with our current [URL="mhtml:{9FA4ED93-9046-4337-90B9-4F5A61FB7A70}mid://00000000/!x-usc:http://www.ico.gov.uk/complaints/unhappy_with_our_service.aspx"]service standards[/URL].

    As we cannot progress your complaint without the information we have asked for it will now be closed until you send these documents to us.

    If you would like any further clarification please contact our Helpline on 08456 30 60 60 or 01625 545745 if you would prefer to call a national rate number.


    So I will get all the stuff together and post it off to them.

    Does anyone think I should follow up the other 3 entries with them?

    dont know...im in a similar position but mines on account overdraft...i moved out 4 years ago and in that time my mums took phones with bt and virgin media in my name and a 500 pound overdraft....its sooo hard to decide what to do for the best....the difference is my mum cant afford to pay it back either.

  • Do you think all I need to do is write another letter to each of the credit reference agencies I originally wrote to, wording as follows:

    "I refer to my letter dated .... concerning debts recorded against my name with various companies which I had no connection with.

    Of the five items listed in my original letter, I have only received a reply in terms of two of them.

    Could you please advise me what the current situation is with the three remaining entries which I originall queried."


    Does that wording sound alright? Any suggestions would be good.
