Calls from creditors before BR - help!

HI all,

OH is has had 56 calls this week alone :eek: :confused: from RBS regarding one loan. He has told them the truth about what we're doing - ie going BR in mid april as we're saving up the fees. He's aplogised and told them he regrets it but his small self employed business closed due to lack of sales and left us in schtuck. They won't accept what he says and say they are charging £10 per call. I've even answered them and told them he's away for a fortnight but they won't listen and we're getting 8 calls every day including the weekends. I'm sure this falls under the Protection against Harassment Act 1997 but I can't make them stop. Any good ideas of things to say? Be grateful as it's really upsetting me now..

    I was just about to post a similar thread... this week ive had so many phone calls..

    Im only 1 month behind with my payments.... im scared already...although i am moving out at the weekend...

    I think the fact that you have told them your intentions will make them hound you more...

    Not sure about the charges for the calls but there must be some law somewhere to protect you.

    I will be unplugging the phone everynight if mine carry on..
  • Tell them to charge you £20 a call if they want. It it is not advisable telling your creditors you are going BR, they will hound you more and more.

  • Thanks for that. I suppose we just didn't have anything else to say and I didn't want to start lying in case the OR got annoyed. I felt that if we kept trying to put them off without telling them it was pointless, that it would carry on anyway. hey ho. I'll let you know if I happen to come accross the solution!

    Yes I would definitely say this falls under the Harrassment Act . I would tell them so and that you are to report it if they call again. Id tell them basically that you have told them before that you do not have the money available to give them any payments and on the advice of CCCS/CAB/ETC you can NOT show favour to them over other creditors. You will send them a copy of your household expenditure and income and you need all corrospondence in writing so that you can provide this to the CCCS/CAB ETC. At this point tell them that any further correspondence by phone will be considered harrassment, as you have made your position perfectly clear now, and you will report it as necessary.

    Sorry just wanted to add that you do not need to send them your household expenditure if your bankruptcy is imminent (I didnt but I said it in the heat of the moment as the "gent" on the phone just wasnt listening to me) and it seemed to work - havent phoned me again and I said everything I advised you to say)

    We changed our phone number when it all started for us. If your with BT they will change your number f.o.c, we just told them we kept getting lots of wrong numbers and wanted to change it.

    It did take a short while for the change to come into effect, but it was well worth it.

    Unplug the phone!

    They lost any right to your respect by calling you 56 times this week. Do not feel guilty - they are abusing you.

    When you are up for it, come back for a letter template to insist they communicate in writing only.

    Thanks for all that. I would unplug the phone but I can't get any phone signal here so we have to use the landline. I'll speak to Sky about changing my phone number but we're moving in 3 weeks so may be we can sit it out till then...

  • blimey...that's taking the doo da isn't it. I read that fantastic thread about the chap who wasn't in arears but was being called all the flippign time - hilarious! I was going to try some of them but as we actually DO owe them I didn't want to get in trouble!

    Oh yes, the do that and it is even funnier when they get the name wrong - mine started sending letters for me to my neighbours' addresses.
