    recieved a letter from the LL today...

    he has come to the reluctant conclusion that to continue would be of no benefit to either party.If I agree to discontinue he wants each party to pay their own costs to date.

    If I have not informed him by Sunday he will file and serve evidence and witness statements.

    I'm partly annoyed that he thinks he can demand a response so quick, I have a busy job/life. Also I am a reasonable person so am I wrong to request my court fee (£85) pack that I have paid?

    It is more likely that your LL has "come to the reluctant conclusion" that a court hearing would probably go in your favour because he failed to scheme-register your deposit.

    You may want to call his bluff or you may like to suggest your own conditions for the "mutual surrender", after perhaps talking your options over with any of the folk suggested in post 19.

    Grab him by the bxxxx. Tell him you want three times your deposit plus more for the emotional turmoil he has put You through.

    i left a note to the LL saying the he could keep my deposit as payment for the month i was moving out

    I recently read elsewhere that this had happened to an unprotected deposit, the tenant had told the LL to take the deposit to pay for rent arrears.
    The general consensus was that because it was used in this manner, as you have also asked the LL to do meant there was no deposit, nothing to be returned or protected, therefore ineligible for the 3X penalty.
