**URGENT NEW UPDATE_LEGAL ACTION** Intrum Justitia & eBay
Truly.Yours
Hi all,
I was unsure where to post this, so I am very sorry if I am wrong.
I have just received a letter from Intrum Justitia this morning who offer 'credit management services'.
It states that I have an OVERDUE DEBT to the client: eBay Europe SARL of £50.02.
The letter has my address on it. But the name of the person is (removed). No one of this name has ever lived at this address. (I have lived here all my life).
It says payment needs to be made immediately. I don't know what to do.
Is there a letter template I can send them or anything?
Please, please advice as I am getting very worried.
Thank you
EDIT: I wrote and posted off the letter given by 10past6 (thank you). I included the original letter I received. I have photocopies of what I sent off.
I have now reviewed a second letter and getting very worried.
Again, this letter is NOT addressed to myself on anyone living/ever lived at this residence.
It says:
‘we refer to our previous letter regarding your debt of £XX.XX and to date we have not received payment of this long overdue account.
Failure to settle your account may result in legal action being taken against you and any legal fees and costs being added to your debt.
What to do next:
You must send payment of £XX.XX immediately.
Full details of how to make your payment are outlined overleaf.
We look forward to the speedy conclusion of this matter.
Yours sincerely
Intrum Justitia Ltd'
Please advise.
Thanks
EDIT 2: *UPDATE*
New letter received this morning from a solicitor firm. Letter replicated below.
'Dear Sir/Madam,
Our Client: eBay Europe SARL
We have been instructed by Intrum Justitia in relation to your outstanding account in the sum of £XX.XX.
Unless our client receives payment in full or a valid reason for non payment of the account with the next 7 days, Court proceedings may be taken against you without further notice.
Should Court proceedings be issues, you may be liable for Court fees and solicitor costs which will significantly increase you balance.
In addition, if Judgment is entered against you, it may impede your ability to obtain credit in the future.
Should you wish to avoid such action you should phone our clients on (telephone number) and one of their advisors will discuss the matter with you.
Please not, we are instructed not to enter into correspondence with you at this sate but refer you to Intrum Justitia. You can contact them on the number above or at the address on previous correspondence.
Yours sincerely,
(Name of Solicitor Firm)'
I am very worried, please advise. Thank you.

Does it really. What concerns me more, however, is why are you posting part of my name on this forum because I have debt with IJ and EBAY. Just I find it immensely coincidental you show up here and post this whilst I have been online? Care to explain?Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.

Please excuse me. I am very sorry, but I don't understand what you are saying...0 -

Well, that name ... looks a lot like my real name. Astonishingly similar to be random methinks. That's why I am asking you, because I have a debt - which I am now settling with IJ so they wouldn't be writing to me anyway right now - with IJ/Ebay which I am obligating. That's why I am asking you. Just you seemed to want to put the name up, for some reason. I mean what if it was my name or someone elses here on this forum for example? Like you wanted someone to see it for example.
If that's not explicit enough an explanation. Whatever. Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. I have removed the name.
I have the letter to prove it.
That name is on top of my address.
I am not sure what is going on.
EDIT: Is it possible there has been a mix up? What should I do?0 -
Send the following letter, the onus is on THEM to prove you owe the debt, not the other way roundTruly.Yours wrote: »Is there a letter template I can send them or anything?
Dear Sir/Madam
Account no:
You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.
I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).
I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.
I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
I/we look forward to your reply.
Yours faithfullyClick here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
I am not sure what is going on.
I'll take that under advisement but for future reference be careful what names you post here in case they ARE connected with a member. That is all. If happens to be 'similar' to my real name then, clearly, I am going to start asking questions seeing it up there on a public forum. If I posted a name that 'looked' like yours I imagine that would be going throug your mind right now as well. See what I mean now?
