Pretty wide open for lots of Paypal claims for non receipt. As others have said write what you like on your listings, it doesn't make it binding. In fact you are going against Ebay rules and the law plus it makes you look amateurish and stops bidders.

For the OP, ask the buyer to check with their local sorting office first. If you think they may be lying you could try calling their bluff and say that you have been told it was delivered and as such it may have been stolen by either the postman or en route, so you hope they co operate with a police investigation, or somethinga long those lines. Its surprising how often buyers with a missing item find that their spouse collected it and never told them!

sorry but what sort of advice is that?
what would you do as a buyer if a seller said this, how can you say its been delivered but has been stolen? straight in with a paypal dispute

i agree i dont think its fair to assume that the buyer is lying - maybe the seller is lying and never posted it in the first place?

I have a similar situation and I have put a claim in to Royal Mail. My buyer has still insisted on opening and escalating a dispute on paypal even though I have kept in contact and spoken on the phone to assure her that once Royal Mail have investigated I will replace or refund. I don't think some buyers behave very nicely even when you go out of your way to help them.

Make sure you take copies of everything you send to Royal Mail and include any proof of posting that you have ie certificate of posting or tracking receipt. Don't send any originals to the buyer as you need to send these to RM!

As said in a previous post, Ebay is all for the buyers not the seller nowadays. Any emails you send to them will have a standard cut and paste reply. I don't think they even care anymore!

2nd class aims to deliver the 3rd working day after posting so its only 2 days past that
    Exactly.

You've got to get 2nd class well into the third week before even thinking of taking any action.

Sometimes neighbours will sign for items and Ive even heard of cases where the postie had put it somewhere on the property for safe keeping including including inside wheelie bins.
Also check they didnt get one of those little cads saying 'you were out come and get it from the post office'. Sometimes they forget to leave the card so may be worth them ringing up and asking if the parcel has been left there.
It's 15 working days before you can make lost item claim. there is a handy delay calcualtor on the RM site and yes the seller is responsible for making the claim.

Royal Mail told me 15 working days after the expected delivery date which should be 3 working days for 2nd class!

Makes no difference though what RM say, a paypal claim can be opened after a week and settled long before RM will even entertain a claim. Always try to get buyer into week two at least, stay in communication and be nice, but be prepared to refund.

    Excuse me!!

Firstly may I thank you all for your replies.

Secondly, as STATED in my first post, I have proof of posting stamped at the PO, so not sure how I can lie that the item was never posted, when it was taken off me at the PO when she stamped the proof???

I have been to the PO today, got the forms to claim on RM, which I cann't do for 14 days. I am in touch with the buyer, and will inform them tonight to hang on for at least the 2 weeks.

I have been trying to de-clutter and make money in these lean times on ebay, and it's working well, this is just a little hic-up, but thank you for guiding me in the right direction of what to do

Believe me I would NOT come on this site to ask for some advice from ebay stalwarts if I lying that is not in my nature.
    Thankyou.

    You are excused.

I was replying to the post which I quoted in answer to this "If you think they may be lying you could try calling their bluff and say that you have been told it was delivered and as such it may have been stolen by either the postman or en route, so you hope they co operate with a police investigation, or somethinga long those lines.
