Challenging council parking tickets

  • Ian..the other posters have given you good advice. I understand your frustration but refusing to paywill ultimately take each PCN within the region of £400.

    There is a possibility that we can help you to avoid any payment but you need to co-operate. To get a PCN cancelled, does in most cases rely on error rather than a councils discretion.

    Firstly name the council. Neil has an encyclopaedic knowledge of PCN's and most likely he will be able to advise whether this council's PCN's are compliant with the law.

    Neil has also directed you to the Traffic Regulation Order (TRO). If the relevant TRO contains errors or loopholes then a PCN can be quickly cancelled. Try and get hold of the TRO.

    I also advise requesting a copy of the CEO's note book entry and any photos. An error may have occured that assists you.

    If you are able, upload the PCN here as well as photos of the signs and lines of the contravention that you have alleged to have contravened.

    The council is Gwynedd Council
    And the offence is "Parked for longer than permitted (Code 30).
    Where do I find this TRO?

    I'm going to go get some pics then upload them...

    well there you go you see. now getting somewhere. I thought you said you were on double yellows?? you can't be parked for longer than permitted on that? You can't park at all.

    TRO is available wherever the Council direct you. Also often at main library. It is your right to view these. If a District Council then they may be held at County level - but usually both.

    Still need to see ALL of the PCN. Nothing specifically recalled about Gwynned.

  • Very important that you get the CEO's log book entry for your vehicle and any photos. You need to establish that the CEO did correctly observe your vehicle as having stayed longer than permitted. The notes will need to have recorded when you were first observed amongst other things.

    The double yellows were directly out my flat, but nothing was done because of the despute. These are the ones they painted over the other day and now set them at the 30mins max. The photos are below, see what you think.

    I'm guessing I'll have to visit or write to the council to get the TRO then. I don't have the original PCN, never even opened it. Done the same thing as everyone else here, took it off my windshield and throw it on the pavement (i know i know, but the stress of these is killing me). I do have a letter here for a ticket given 09/02/2009 giving me 28 days to pay £50. Though it also gives me the choice to make a representation.

    No, I wasn't on the double yellows when I got my tickets, I was in the 30mins max shown in the photos above.

    No, could be a good idea. I'll try and find out who it is. I did email a councillor about the poor broadband service we get in the area from BT. He did check it out, but was powerless to do anything about it.

    Don't ask the Council to send the TRO - go and view it.

    I think I'm confused to what a TRO is now.
