Broken button on jeans sold yesterday on Ebay

Hi hope someone can help me with this query.

I sold a brand new pair of jeans on Ebay never worn with a tag on them yesterday and posted them off as soon as the buyer paid. I have just received an email from them saying that the button has just fallen off the jeans and left a big hole (I take it it is the main one at the waist). She had taken the label off and was turning the jeans outside in to wash them and the button just fell out. The button was definately ok when I sent them and they have never been worn as were too small for me ( I bought them in the Next sale thinking I could lose weight and get into them but realise that that is just a dream!!!) . She is requesting a refund but I don't know where I stand here ie do I have to refund her? She is asking me to refund her the price she paid and also the cost of her returning them to me.

I have bought and sold a few things on Ebayand this has never happened to me so just need a little help. Thanks

I'm only a man but I've lost a few buttons in my time and they have only left needle holes unless I've had an accident and torn it off. Sounds a mite iffy to me.

I think the button is the main button on the waist band so it is a stud-type which goes through the waistband so i suppose it would leave a hole but I just dont really understand how it would just come off.

I guess she found they are too small for her too, and in her efforts to do up the button pulled it off!

I don't know about buying jeans on ebay but surely it's a bit like buying a second hand car, from a private seller. Buyer beware. It's not like you are a company, i think i'd be saying, well they were ok when i posted them off, so tough.

Unfortunately paypal don't see it that way and a claim could go either way and with new goods paypal tend to favour the buyer.

I find fairly frequently that I get emails from buyers saying there's something terribly wrong with their item, such as the fabric looks a different colour in different lights:rolleyes:. I always tell them to send it back and I will refund if it's returned in the condition in which it was sent.

Funnily enough these complaints usually come quite a while after the item was posted (so they have had chance to wear it perhaps?), and the items often don't get sent back.

Tell her to send them back, but you will not be responsible for the cost of the return postage. Also tell her to send them Recorded, so she can't say she sent them, when she never.
