Purchasing but not receiving my goods

I did an expensive purchase 3 weeks ago, It was for a tool to use for work, I am self employed.

The person that sells the goods has a website and is based in the north of England (he was even on dragons den), I viewed the product and wanted to get it, he wanted cash transfer but I only had credit card, the product was £2185.

Any way I spoke to the chap selling these, he has got a business specific to the product, I asked could we try paypal, he send me an invoice and I will see will it permit me pay by credit card. that failed, but the guy showed no emotion and we just chated and I told him I will try and get a credit card cheque.

Any way I have 2 credit cards, I put £1185 on one and £1000 on the other, it was just when I paid I found that one of the credit card cheques was not going to go through as I was £40 short.

I send the chap an email right away and explained with the halifax I put in £500 but it takes a few days for the money to be in my credit card account and i was sorry but the cheque would not be honered, I told him I was aware they may be a fee but that would be acceptable.

4 days layer I wrote another 2 cheques one for £1150 and the other for £1000, both cleared and he has the monies in his bank. I know the total price was £2185 but as I explained to him in a p[revious email I knew there would be charges and for him to tell me, also I was going to pay they extra £35 with the charges,

all in all when he knows its me on phone I only get answering machine, i can put 141 before my number he replies but once he hears my voice he hangs up.

I will go bust if I do not get my purchase, I have left messages and begged hi by email to let me know what the issue is, I have spoke to companies that do business with him and they say his business is in fine shape.

Can some one please tell me what can I do to either get my product or get my monies back, I have not raised my voice with this man but feel I would really like to but understand that it wont get me anywhere.

Can some one please tell me what rights I have.

Can I take him to court and close his buisness if he does not either give me my money back or the product.

I will go bust myself in 4 week with out the product or the cash back

I would be v v grateful for your advice.

I think it's just a matter of chasing him. Maybe phone Duncan Bannatyne and see if he'll sort him out.

I would be straight to the small Claims Court as quickly as possible on this one. I cannot believe how naive you have been in parting with money under these circumstances.

IF the product is for sale what else can one do, i checked the company out, It was on dragons den I called it on and off over 3 months. what else could I do. I received an invoice so i paid expecting to get the product. One can be considered naive what ever they buy in this world.
