Online Purchase - Incorrect Price Advertised

Hi, yesterday I saw on the HMV website that a mistake had been made on the price of an XBox game - £1.00 instead of £39.99. I ordered 3 games and received an order confirmation email back from HMV for purchase price of £3.00 with free p+p. Now today I have received another email from them telling me they have spotted their mistake, and are refusing to honur the order as the money has not yet been taken from my credit card. Can they do this or do I have a good case to push for fulfilment of the order ??

    Yes they can do this, an agreement to honour said price would only occur had they taken payment from your card.

    They dont have to honour this, buying online is no different to the shops, its called, invitation to treat

    This is the most important part of it. You knew there was a pricing error and tried to take advantage of it, they don't have to honor it. If it was meant to be £39.99 and they had it at £34.99 that would be a different story.

    Rather than just order 1 game and hope you will slip through the net you had to be greedy and order 3.

    Tesco & Xbox Console ring a bell....
    I admit I did order one of these consoles at £50 hoping they would honour it - which they didn't. Hey Ho.

    It has happened in real life. Shops getting the decimal point in the wrong place, and once you've paid for and taken posession of the goods, there is nothing they can do. But until the money *and* the goods have changed hands they can still put a stop to it.
  • I have just purchased some goods online (as it happens rope for my boat) at what I thought was a very good price to the value of approx £60.00. The transaction was completed by payment with my debit card on the suppliers secure sight, I received an email/reciept confirming the order and another confirming payment. I then had a phone call to say there was a problem, the goods were listed at the wrong price and they would come back to me. I then had an email to say the goods were despatched and then another call to say the could not supply at the advertised price and the had refunded my payment.

    Do I have any rights in this situation if so what are they please ?
