    Many DID see it coming, but others were blinded by the thought of an earner, they only saw what they wanted to and were taken advantage of by developers.
    As far as the DI goes, I would suggest he has much better things to do and is probably just humouring you.

    OMG Jeynes!! There ARE ppl on here that are real and genuine.

    The solicitors are the sadiest ppl of all so far. The police told me last week that so many law firms wased their hands of challenor and wanted nothing to do with them at the time.

    The copper suspects the solicitors were acting for me AND the vendor too - they even asked me dsgn bridgin loan paperwork 6 months after the "event" and return undated to them witnessed and undated again.

    Dodgy as fuk.

    U see, I wanted a good deal. No crime in that. We all do - good interest rates from banks, cheap deals, buy get one free offers from shops etc.. this is no different.

    I was no "experienced investor" but I bought their sales talk. They seems above board, constant telephone presense, website looked fine, addresses verified, no bad press etc... i could go on of course..

    the was nothing bad about them. Went to see the plot, all was good, builder said all the right things - it would have been impossible to know the plot cooked up behind the scenes when all parties were involved.

    I will be identifying the solicitors area of guilt here once I can get the paperwork from the crime dept - i will lodge an investigation through a private law firm and the SRA.

    It is so complex and a long way to go - but as far as the bank is concerned, at best there are un answered questions and grey areas to lighten.

    Its funny, cos most ppl in this thread are jumping to the banks defence on contractual grounds and "their right to do this and that in law etc..." at the time - yet these are the SAME ppl that finger point and curtain twitch when the consumer claims an unenforceable credit agreement,. They are the same ppl that say its wrong, its immoral etc...

    amazing PC on here..!

    YEH OK! Erm, did i mention that all this was 2006 and not 5 minutes ago?

    Did I mention the the DI came from Yorkshire to London to meet and take statements from ppl including me and a friend. We had a 5 hour meeting going thru paperwork together and there are more meetings to come.

  • I do like this forum and there is some great advice on here. But there are also a lot of people who love to put the boot in a bit.

    Cashpig, if your solicitors have been negligent, personally I would pursue them now rather than waiting. Remember there is a time limit for bringing a professional negligence claim, I think it is six years from the date of the negligent action. Plus, if your solicitors are dodgy, you don't want them getting wind of the investigation and losing or doctoring your file. It does happen unfortunately.

    When you paid stamp duty, do you remember if you paid it on a purchase price of £150k or £180k?? If you paid it on £150k then your solicitors would have a lot of explaining to do!

  • And look everyone, from what Cashpig has said, he has been deceived or his affairs were mishandled by everyone from his SOLICITORS (the people you should be able to trust implicitly), the builder, the broker, the mortgage lender. I think all of us would end up in the deep proverbial if that happened to us.

    Well, I paid SD of £1,790. My friend who bought exactly the same thing with the same price paid SD of £1,520.

    The purchase price of the flat - the actual money paid to the vendor was 150,000 so the SD should have been 1,500.

    My friends one seems right, only of couse there is bank paperwork showing a purchase price of 180,000 - so the SD is odd in that repect.

    The SRA have told me that I have 6 months to lodge a complaint with them regarding bed service/misrepresentaton from the solicitors.

    These were lawyers that were expressly chosen by challenor. They was no choice in the matter at time time as we were told that they were "familiar with the protocal of the system and have been approved" by somesort of official body etc... The have since ceased trading.

    I know in summary it looks obvious - but this information was spread over a time line of around 5m months and backed up with cleaver customer servcie talk and other ppl like brokers confirming the system etc... so it all seems in hand - and we thought that so many established firms could not be wrong.

    However, this is why it was such a succesful con. There was a discount, only the purchasers didn;t get it. It was all done long before we turned up and they knew that we would none the wiser for a long time to come.

    I haven;t lost anything either. Its only a paper-theoretical loss until I turn the property into a cash sum.

  • There should still be indemnity insurance in place for the solicitors (says it all that they have since ceased trading!). Good luck with your claims, all the circumstances are way beyond me so I can't say anything helpful I'm afraid, other than the very best of luck to you and I hope you get it all unravelled.

    These ppl that are slating me in this post are no better than the con artists that created this scam. They are the supporters of such as should be reported to the police.
