Help Regarding My Tenancy/Problem

Hello Everyone,

I'm here because i need some advice regarding my tenancy. It is an assured shorthold 12 month contract with a private landlord.
I entered into this agreement on the 16th Jan 2009.

We really DO NOT want to live on this estate anymore, everyone is rough, rude and abusive. I'm contacting my landlord on Monday and wanted some advice before i do so.

How can i end my tenancy early? Am i able to? There appears to be nothing on this subject within my agreement.

Any help or comments would be great.

    You can do a runner. But is a black mark on your record unless you change your name etc and hide forever.

    Do you have a break clause?

    I have no idea, i've read through my agreement this evening and there only appears to be information on how my landlord can evict me. Nothing about what happens when i want to end it early.

    Ok you should ring shelter. The number is on their website. They'll tell you exactly what you need to know.

    If you seriously think you're in danger then speak to the police.If you're worried ring 999 - else ring the main switchboard number.

    If things don't calm down then remember money is only money, so moving out for safety sake is worth being in financial mess briefly.

    I'm sure it's just friday night hysteria in numpty town though. There's some really strange places in the UK - and 99% of people are all mouth.

    The whole point of having signed an agreement is that it protects both you and the Landlord. How would you feel if the Landlord suddenly decided to kick you out after a month because he didn't like you?

    You can't end an AST early without a lot of hassle and expense. Did you not investigate the are before signing a the AST???:confused:
    My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say ;)

    You don't know how deep the mud is until you step in.

    You might have signed a AST thinking an area was not full of nutters.

    First off, you have agreed to rent the property for 12 months - this might be described as the Fixed Period in the tenancy agreement.

    If there is no break clause, then both you and the LL have a binding contract that covers 12 months. If there is a break clause, it usually allows you the option to give notice to leave, once you've been there six months.

    Either way, if you want to leave, then you and the LL need to agree on this as you need to agree to terminate what is otherwise a legally binding contract.

    You will need to discuss this with the LL. And you will need some careful negotiation skills as there is no reason why the LL should agree. One thing you ought to consider is helping with finding new tenants - offer to all prospective tenants to view the property whilst you are still there, for example. And for heaven's sake, don't say anything derogatory about the property in front of prospective tenants. In fact, consider not being around when they inspect so you are "not put on the spot" with awkward questions!

    Negotiation with the LL is the only forwards - don't lose your rag with the LL or be rude/angry, as you need the LL's sympathy and co-operation.

    If you want to move out before new tenants move in, you will be liable for the rent until new tenants are found, at the very least.

    Agreed...to a degree, however, it puzzles me why people would happily sign a contract without finding out what their obligations are.

    It appears i do have a clause in the contract to end the tenancy early, so will be proceeding with that.

    It's not so much the area, it's more the street we live on. We looked around a few times before moving and all seemed to be in order. We then signed the agreement on the basis that it "seemed" a nice area to live, so we were quite happy to enter the 12 month agreement.

    I have come to realise that all rejects from society have been housed here.
