Cancelling Diamond Car Insurance HELP!!

Hey let me explain my situation. I had been with Diamond Car insurance for 2 years and recently decided to change to Admiral cause they were £40!! cheaper a month than diamond.
I knew there was a cancellation charge since I was in the middle of my policy so I phoned up prior to cancelling and spoke to a guy who told me it would be between £40-£50 to cancel cause it goes by a pro rata system. I also told him that I was planning on cancelling on the 25th of Feb but I knew my insurance came off on the 26th and I clearly asked him if I would have to pay this and he said no I wouldn't have to. That was fine.
So I phoned up and cancelled and got told that diamond were actually due me £91.47 and so they would take the cancellation fee off of this and so were due me £41.60. I thought grand... at the end of the phonecall the guy said "thats it, cancelled for you. You can now cancel your direct debit". Which I did.
That £41.60 never went into my bank account and I phoned diamond to discuss why. I was told that I was actually due that payment on the 26th so they took back the £41.60 so now I was due them £50?? I told the woman on the phone that the guy told me I wouldn't have to pay it and she said she would speak to her manager and see if they can go back and listen to phonecalls and if the guy did say this then I wouldn't have to pay it. She said she would return my phonecall the next day which she never did. So I phoned up today and spoke to a guy, told him the story and he said that theres a note on my policy saying that they didn't listen to phonecalls cause whether or not the guy did say that I still had to pay the money. Is there anything I can do about this? Your help is appreciated!!

If they have told you something wrong over the phone and someone made a mistake then I'm afraid I don't believe you can hold them to it.
It's very frustrating I know because I've had simialr experiences, but you cannot force a company to honour an error.0 -
It depends when your instalments were due eg whether you were paying in arrears or in advance. Insurance monthly instalments are often in arrears so it is likely you owe the money.
If you do pay in arrears then they are likely to still want the money as the person you spoke to made a mistake and you will technically owe the money. You can try and push them to drop it although I doubt they will as they will be entitled to it and the fact you cancelled your policy mid term to go to another Insurer will mean they will not go out of their way to do you a favour.0 -
take a look at your policy booklet? what does it say the cancellation fee is? (an amount or a pro rata of the remaining policy?) How many days did you have the policy running for?
days used divided by 365 or length of policy is how much you should have paid, plus add on the cancellation fee/charge.
then add up the value of all your direct debit payments plus any payment as deposit at the start.
Now, which is more, the value you should have paid, or the value you did pay?Indecision is the key to flexibility0 -
As Diamond are in fact an Admiral brand, I would speak to a manager/supervisor and explain that you are staying within the Admiral family and therefore ask that the cancellation fee be waived.

Hi there
I don't think that they are being very reasonable with you.
At the end of the day, I would draft a fax/letter to a manager and explain what has was said on the telephone.
Do mention that if this is not sorted you will have no option, but to report the incident to the Financial Services Authority. I believe that they would look on the situation more favourable to you than Diamond.
