Could we be turned down by the court?

Hiya blackbird
Just to be sure - are you in Scotland, England, Wales, or Northern Ireland?
If you're in Scotland, CCCS's advice might be roughly correct (though you don't have to go through the courts to make yourself bankrupt here).
If you're in England or Wales, then the folks on MSE know what they're talking about, and it sounds like CCCS have given you some dodgy advice.
If you're in NI, I'm afraid I haven't the first idea how it works- but I'm sure there will be someone on here who does! :T

Yeah we are in england. Sunny southampton:D .
Talked again to cccs and yep if the court thinks you can repay it within 10 or even 15 years they wouldn't allow you to go bankrupt.
So we will get more advice and may have to stick the debt plan for the next well I think 12 years  .0 -

Totally wrong, please seek second opinion from CAB or National Debtline0 -

I would take CCCS' advice with a large pinch of salt here. There have been some examples of plainly wrong advice from them recently on this forum. Phone or talk to the others, you may find BR is recommended. If so, ignore CCCS on it. You can still say you have taken advice to go BR with impunity.

can you not consider an IVA???0

As they rent they're property and have no assets to protect an IVA is pretty pointless.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

Debt remedy on CCCS website may be an option.
I suggested IVA as they have means to pay their debts.0 -
IVA has been mentioned but again cccs said that the main creditor is lloyds with £25.000 and there are likely to say no to it cause of our income.
Yeah we sold our property 2 years ago as thinks went down hill for us and had to pay on top to sell. Now we got good and save jobs again we find that we are trapped cause we earn to much.0 -
I've seen people go bankrupt with a larger surplus than yours, and calculated the IPA for them.
Please speak to someone other than CCCS and get a second opinion.0 -
From the information you have given us, CCCS are obviously wrong on this occasion. Go down to citizens advice, or call up national debt line.“The ideas of debtor and creditor as to what constitutes a good time never coincide.”
