I'm a first time 'poster' and would like to ask if anyone knows whether I'm tied in to an Estate Agents Terms & Conditions if I haven't signed them?

As a retired EA I would say definitely not but with one tiny niggle. That is my solicitor told me years ago a conversation could be taken as binding but only if there were witnesses. But this latter point would prove to be very rare and not likely to be taken to court.A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.0 -
If i havent signed anything, i would not say i was tied into anything. So if they came at me, id tell them where to go. However, EA's are dirty rats, and play dirty tricks and dont be suprised if they dont just let it go.I am NOT a mortgage adviser, or anything else!Infact, Im not an anything advisor and really dont know what im on about!0

Can I correct you suggest you mean "some EA's" not all.
There are a number (EA's) on this board who bend over backwards to help people out with inside advice - like myself.A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.0 -

I would think that if a viewing had taken place then you would be deemed to have accepted the the terms of their contract as well. By accepting a viewing you are almost certainly accepting their services.Everything that is supposed to be in heaven is already here on earth.

My solicitor always said this was the case but never had a situation where I had to prove it. I went from a 'shake of hands' many years ago to having a water tight agreement to save my getting shafted. Doozer is right, there have been many cases in which the vendor has been judged against despite not having signed the agreement papers but subsequently have accepted viewings/offers etc, even accepting the for sale sign has been judged as accepting the terms of the contract.0

Have you verbally asked them to sell yr house? Have they put it on their website, put a sale board up, or printed schedules?0 -
