Thanks everyone. Some of the replies made me chuckle. You're a witty lot aren't you? I think I should clarify. I'm not actually selling. I own a flat that I let out. As the previous tenants had to leave unexpectedly just before Christmas (obviously not the best time to find new tenants - leaving aside credit crunch probs) interest has only just picked up again. I put it on with EA at the time and after several weeks of nothing decided to advertise it myself in local paper. The response has been very good and I now have a very nice prospective tenant. Trouble is my lady only confirmed she wanted to take it AFTER EA found someone, and has now gone ahead with referencing etc. On reading their T&C's (which I haven't signed) I was more than a little worried to read the following "there is a minimum fee of £400 plus VAT for any Tenant Find and should the landlord withdraw from a prospective tenancy where satisfactory references have been sought and legal documents prepared, the minmum fee will become payable".
I wasn't made aware verbally about this clause when EA 'phoned me for agreement to obtain tenant refs etc and although I know they have incurred some costs, expecting the full fee simply because I prefer another tenant seems way over the top. Advice would be very welcome0 -

Good well balanced comments and so true.A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.0 -
A contract does not have to be written or signed.
It can be made orally or even by the conduct of the parties in some cases.
From an evidential point of view anyone thinking of issuing on an unwritten contract should normally proceed with caution.0
