Refund of Paypal? Advice please

Hello
I purchased an item off paypal which turned out to be a fake ( advertised as genuine), seller said i could return it for a refund. I returned item on the Tuesday and got little communication after... i sent a couple of messages asking if she had received the item back and was told that seller was away for weekend and when they returned home on the monday would refund them.
On the thursday i still hadnt heared anything from the seller & was told i would get my refund monday so i send another message, that evening seller emailed me and said they hadnt been to post office to pick up the item ( why couldnt she have emailed and told me that) but would take my word for it and give me refund.

On the saturday i still hadnt heared anything & not received my refund and so i emailed again. I got a responce almost straight away saying they had gone to the post office the day before and item wasnt there and she said it may have been sent back to me ( again why didnt she email and tell me this).
I have been waiting long enough for my refund and now it doesnt look like i will be getting it at all as item now 'lost'. I have opened a disput on Paypal- as theres little communication & i dont think seller will give me a refund now as saying not received item back so will paypal still refund me?

Let's hope it gets returned to you. Shame you wasted the postage though - you do not have to return fake items. (Search for the million and one 'I bought an item and it's fake' threads here)
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • I know, well i said to her either refund or i'll claim through paypal. She said she would refund, but not postage ( Lost £10 in postage fees now)
If she still claims not to have received it do you think i would still get my refund?

Yes you will still get your refund. I would also report them for selling fake goods on ebay.

I doubt it if the item is lost. Maybe when it tuns up yes. The OP has no proof the lost item was fake its the sellers word against the OP and the seller can prove delivery, can the OP?

did the seller send it recorded?
if the seller went to pick it up then they would have had a P739 card
RD's get 7 days so its most likely been returned as the seller states
the op can check this on the RM tracking
  • Well it has been over 7 days... I posted it 1st class on the tuesday & seller said that she got the card on the friday and couldnt get to the post office till the friday after.
If it does come back to me, do you think i should keep it ( Not spend another £5 sending it back) and claim through paypal?

    Fingers crossed it turns up!!!
