  • You're welcome Cherry, the CAB won't pursue it for you, it'll be down to you to complete the ET1 and get it submitted, just remember the deadline dates for tribunal claim. They should give you advice on how to get your points across, but I know they are mega busy at ETs at minute so will probs be several months before you get a hearing date.

    If you file, Acas will then get involved to try to conciliate between you to prevent it going to hearing, and this can be really good, even if most companies play hard ball to start with to test your mettle

    There's always a contract, even if not a written one. A verbal contract is just as binding.

    But considerably harder to prove....

    Hi,
    As above, partner "made redundant" after 7 years loyal service (full time). No written notice/no verbal notice or contract/asked to leave Friday 2 weeks ago. Has spent subsequent two weeks (Mon-Fri 08-17:00!), seeking advice from CAB/Job Centre/legal aid solicitor who said he has a water tight case for Unfair Dismissal. Most of the time waiting in CAB office/Job Centre.

    Thanks to the MSE'ers who offered advice, all taken and am now just waiting for the process to roll and finish. Solicitor worked out he's owed 5kplus, they gave him 2k.

    Will inform when monies through and done and dusted. Best of luck to those in similar or worse position.

    Hello folks,
    Just to update those interested...brief recap - Partner got laid off with no notice/consultation/redundancy pay after 7 years two months ago. Signed on for JSA successfully and got legal aid.
    The berks who formerly employed him are so up their own you know what's they were arrogant and tried to bully him/dismiss him by messing him about with a date for meeting face to face to discuss. Eventually met with them and they admitted they'd done wrong and tried to pay him off. His legal aid solicitor told him to tell them to liaise thru her and they are so daft, they then sent him a letter which dug them much deeper in it. Currently being dealt with by solicitor.
    So, just to say hang on in there if you need to, it all takes time. But I think justice will be done, fingers crossed. Will update.

    Cherry good news that you will be getting what is owed. As a payroll/HR manager for a comapny that employees 1500+ employees I must say that they have done a pretty por job on the legal side!

    Yes, well, I am always suspicious of smaller companies as many seem to make their rules up as they go along. Certainly this one has. They were so cocky they didn't even bother looking on the internet to check basic employment/redundancy rules. Thing is, most of their staff are cash in hand/immigrants so I think they don't care.

  • Good news Cheryl, lets hope your OH gets what he is owed soon enough, have you actually submitted an ET claim though? Cos dont forget you have a 3 month time limit for unfair dismissal claims from date of being dismissed so just be careful the employer isnt delaying settling with you to take you out of time....
