If it was a tie breaker situation then the solicitor told us all that is was justifiable, because by the time you ended up at tie breaker point you would have exhusted the other options.
And the solicitor gets rich after being employed to defend the company against age discrimination claims.
Seriously solicitors fees can help destroy small businesses.
Any situations where an employee can easily put in a claim for discrimination regardless off whether it was not, should be avoided.I'm not cynical I'm realistic

I think we may well have to agree to disagree, but consider:
When chosing a matrix there are many things that could be classed as indirect discrimination. If you use education are you discriminating against those who are not young enough to to go to universty fee free? If you use skills are you discriminating against those haven't been with the company long enough to aquire xyz skills? If you use adaptability, is that just subjective? It's all abit wooly.
I'm pretty sure that a solicitor would be hauled over the coals if he was giving out incorrect information to a couple of hundred people though. As you have to remember, it's all about what a court would consider "reasonable". Is it reasonable if you have 2 identical staff members to keep the one with the longest service?
