E2Save set up a different contract from the one I ordered and confirmed with them!!

I purchased a Sony Ericsson T303i for my girlfriend to use on the 13th of Jan. On the add it clearly stated the following:

Sony Ericsson T303i Pink Clearance
Combi £30 + £5 Web n Walk 12m
Acer Aspire 5315 Laptop Clearance + £90 Automatic Cashback
PLUS 1 Month FREE Insurance (£5.99 pm thereafter, can be cancelled) and VIP Gadget Helpline FREE for 1 month (£2.99 a month thereafter)

(order confirmation saved in an email and printed out)

Today I when browsing through my t-mobile account online I realised that they had instead put me on the combo 35 + £5 web n walk package. Either I was mislead and they thought I wouldn't notice because I pay by direct debit or they made a mistake.

Either way I haven't received the £90 cashback which they said was processed on 2nd of feb and they also said they would send a cheque of £60 to cover the extra £5 I would have to pay for the combi 35 package when I called them today.

Also I only received 500 mins and 372 text messages and on their website the add stated I would receive 700 mins and unlimited text.

I also had to pay a last minite £9.99 for royal mail special delivery which was never stated on the advertisment and when i looked at the invoice when the package arrived it was sent by city link.

My circumstances have changed since I took out the contract. I am no longer working but currently looking for work so life would be easier without this contract phone.

What are my options?
Can I get this contract cancelled?

Any help will be much appreciated. I am ready to type up letters and do what ever it takes to sort out this situation. Thanks

The reduced allowance may be because your allowance was pro rata for the first billing period if it was just a part month.

With regards to the missing cashback, check the ts + cs, and if they have breached them by not paying you on time, follow the LBA and MCOL route to get the money (see the e2save problems thread for details).

But your contract with t-mobile is a separate one, and binding. As e2save have agreed to compensate you over the wrong tariff, then there seems no grounds to cancel it.
  • Oh no.. So theres no way out this contract.
