Capital One reclaim Query

I had an account with Cap One which was sold to a debt collection agency. Many months ago I managed to negotiate a settlement figure with the debt collection agency and cleared it. Since then I have been trying to claim back my charges from Cap One, this is now with the FOS. My question is if I am successful will Cap One send the money back to me or the Debt collection agency?

    I'm in a similar situation as my Capital One credit card account was defaulted and passed on to a recovery agency.
    The problem i have is that i no longer have anything with the credit card account number on as any correspondance i get from the recovering agency only has their Reference on it, not the original account number.

    How do i obtain my old account numbers? I could write but i have an active fully upto date credit card with them, would it be mistaken for this one? Also what address do i send the request to?

    Any balance owing after the debt is repaid (which you claim was settled), will be forwarded by cheque to you.

    You can send a standard template letter request to the DCA at the address on their letterhead quoting their reference. They would then pass this on to their client and subsequently forward this to you. Once Crap One send you the copies of your statements, and you put your claim to them, they will send you a letter saying that they believe their charges to be lawful blah, blah, blah. Once you have this letter, you can go through the FOS. They do take about 3 months, but it is free. Crap One will then come back with a realy crap reply, which will be nowhere near what they owe you, so reject their offer.

    They will then offer the full amount plus interest. Just hold out. They will repay any debt outstanding and forward the balance to you.

  • In response to the OP I would have thought they would pay off what you owe them and then send you a cheque for whats left. If it was a negotiated offer (I am guessing something like you pay off 75% in full and final settlement) I dont know how you would stand. I dont know if they would be allowed to claim back the rest of the figure that was outstanding as the settlement figure was presumable in full and final settlement of this debt?

    Im having real trouble with Cap One too - I sent off request for statements and cheque for £10 on 31/01 - they sent me back letter offering £252 which is difference between £20 charges and £12 charges. I did not want to accept this as from the statements I have (which is not all of them because they seem to be refusing to send them to me) my whole amount of charges is in the region of £1100!!!! I therefore sent the second letter by post on 07/02 which they deny having received (I know I should have sent it recorded!!) so I faxed a copy over to them last Friday and still have heard nothing. I have been told 3 or 4 times that my statements have been posted but I am still waiting............. I am just waiting at the moment for the 40 days to be up since the request and then I will report them to the Information Commissioner. Does anyone have any adivce on whether I can claim yet to the FO? Or would they want me to wait until 8 weeks is up? Thanks for your help.

    So i'd have to send the first letter along with the £10 postal order to the Debt Collection Agency? Do i still address it all to Capital One on the letter or should i put the agencys address on it?

    For charge claims deal direct with the original creditor, thus cap one. they are the ones who charged you and they should refund you regardless of any arrangement you have made with a DCA after default.

    Seperately tell the DCA the account is in dispute with the original creditor.
