Bought item damaged, can I get compensation for collection hassle as well as refund?

  • not really.

If you had this mirror hanging on a wall in your house you'd definitely have noticed the damage not to mention the process of photographing the mirror when you couldn't miss it. Obviously goes to show that I should have checked all sides when picking up!

One bit of damage was in the shape of a Z probably scratched by a kid and definitely not caused during transportation as it was well wrapped in serveral blankets. The fact that the damaged area had the same amount of grime as the rest makes it obvious it was there quite a while.

Whenever I buy something to collect - I ALWAYS check it before paying and taking the item. It seems to me that it is your own fault - you had the opportunity to inspect the item, you didn't bother doing that and now you are trying to use negetive feedback as a way of extorting a refund from the seller.
Whether the mirror was damaged or not - the buck stops with you for accepting the mirror in the state it was in when you collected it. I really hope the seller doesn't back down on this one.

Of course I mention the 100% feedback in association with getting a refund , He may think it's worth protecting his 100% for the sake of £16.
The compensation issue is what I'm asking peoples opinion on.

I can’t believe that you’re contemplating leaving negative feedback just because you couldn’t be @rsed to check something over.

Do us all a favour and tell us your ebay user name so none of us have the misfortune of trading with you.

Exactly what I thought on reading this thread! Thank you for wording it better than I could have done, CM. :)

Thought you said he was selling it on behalf of his friend? If that's the case he would never have had it hanging up in his house.

And yes you should have checked it, can't recall the exact phrase but something along the lines of caveat empor?

Your mistake, not the sellers and asking HIM to collect it? Ridiculous. I hope he takes the hit of 1 negative on the chin and you don't get a penny back.

It depends I guess how much he values his 100% feedback

Blimey, I could almost hear this quote coming from The Godfather - since when did we hold Ebay sellers to ransom?

I won a bid for a child's dressing table about 2 years ago. I agreed to collect (35 minute drive away) and pay cash on collection. When I arrived I could see that the dressing table was in a lot worse condition than the description implied. On this basis, I told the seller that I could not buy it in the condition it was in. She accepted this and Ebay were notified. Annoying, yes, but at no point did I expect financial compensation for time or petrol.

If you think you could see the damage when the mirror was hanging on a wall, how comes you didn't see it when you inspected it?
It's wouldn't have not wouldn't of, shouldn't have not shouldn't of and couldn't have not couldn't of. Geddit?

All this for £16 for an item that you collected and therefore had the time to check, examine? madness, you could've walked away saying "no thanks mate," unless of course you are visually impaired (...almost blind, but then I guess you wouldn't have driven to pick it up). But buyer beware springs to mind in this case.
Also can the OP post their ebay username so we can block you from bidding on any items we might be selling?

Personally the £16 isn't a big deal, it's the annoyance at being lied to that winds me up and makes me want to get even in some way. Childish I know....maybe tomorrow I'll have calmed down!

VERY childish. What you're doing is blackmail and negative feedback extortion, and people like you should be banned from ebay.

If you've mentioned anything along the lines of "give me a refund or I'll give you a neg" in your messages to him, then he could get you banned!

If he'd sent the item in the post, then fair enough, but the basic fact is that you went to pick it up, thus having ample opportunity to examine it!

    Two points:
    1. If you'd gone to that much effort to put all your car seats down to fit it in etc... then I can't believe you didn't go to any effort to examine it first.
    2. If the damage is THAT bad and you can't hang it up, then it would have been instantly noticeable when you went to collect it.

If you go ahead with your claim, then it's a really low thing to do.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
