How Long Does The Dvla Keep Motoring/speeding Offence Records On Their Files?

    Thanks Hinzta,

    Well I was trying to find out if they should have been keeping the records for 5 years (I mean insurance always ask you to provide details of offences committed in the last five years - whats the point if most of them fall off the dval system after 4 years?)

    It because they had no record of his speeding offence on their system and I thought if they had to keep it for 5 years then that was one get out of jail card for us.......but as it stands that one wont work!!!!

    When did he pass his test? Was the licence revoked under the "too many points in the first year or so rule"?

    Unless you can prove there has been an almighty !!!! up I suspect cops will go for no valid licence. I think your friend not chasing this up in the last 4-5 years is at the least a little remiss but strikes me more that s/he took the attitude keep my head down and it will go away.

  • Sorry, only read your other thread after posting my last comments.

    At court, the one way street offence is likely to either be ignored (Due to the more serious matter of Driving not in accordance with a licence), or your friend will be able to dispute it adequately due to your original reasoning (No signs etc.). With regards the licence offence, the court will probably take the view that, whilst your friend took the effort to apply for a new licence when he couldnt find his old one, he should have made sure that the points were listed on the licence, as they would (or should) have been clearly listed on the paper counterpart.

    As for the no insurance matter, as much as they may have reported him for this offence, the Crown Prosecution Service (Or Criminal Protection Service as I like to call them) will never run with it. The reason being is that although his insurance company would unlikely payout for his damages in the event of him having an accident, he would still have cover for third party risks. They could try and go down the route of charging him with Gaining a pecuniary advantage, (This is when someone, for instance, tells their insurance company that they have a full licence to gain cheaper insurance, when infact they have a provisional or no licence), however, to prosecute for this offence, it would have to be proved that this was done intentionally, which (if what youre saying is true, about honestly not knowing his licence had been revoked) you should be able to argue.

    Lastly, ans on the point of his licence revocation. This is entirely possible. Your driving licence remains the property of the DVLA forever, and when it feels you have done something contrary to the terms and conditions of that owning that licence, they can order it to be revoked. In this case, it would have been your friend failing to return it to have it endorsed. They will only send one letter to the address on your licence, asking for its return, and then they will simply keep a record of its revocation on their system until it is returned (Usually, as in this case, when someone is stopped by the Police).

    What interests me though, is how you drove the car away? Obviously, they wouldnt have let your friend drive it, as he had no licence, so they may have let you drive it had you been suitable (Licence and insurance, etc.), but depending on which force area you were in, Id say youre actually quite lucky not to have had your car seized, which alot of Police forces do now to keep un-licenced/Uninsured cars of the road.

    Would be interested to know a bot more about this.
