no parcel - but royal mailsay it was delivered

We purchased an item from ebay, we contacted the seller when we had not received the item, he has been in touch with Royal Mail, they have supplied him with a signature and a typed name, we have explained that the signature is nothing like ours, and when you have something delivered by the postman the tracker code is placed onto a piece of paper where you then sign and print your name, along with other signed for deliveries that day. There is no copy of the tracker code next to it, and it looks like it has been signed for one one of those electronic signature thingys. Royal mail are now saying they wont do anything and the ebay seller is refusing to refund us, what should we do?






Any advice really appreciated

    Thank you very much for sorting that out for me. I dont know what happened there, I could not work it out so deleted it, I am more than happy to keep the letter on.

    Yes we are fuming. Royal Mail say we cannot do anything because we are not the ones who sent the parcel, it is down to the seller, it seems to be ok for the for us to be out of pocket and with no parcel.

    Royal mail are correct.

    You need to tell the seller that you did not receive the goods and the signature etc was not done by yourself and thus you require either the goods or a full refund.

    if he doesnt comply start a paypal/small claims action for the money.

    Actually both are right. It would normally be up to the seller to sort this with RM, but you can claim for the loss too if necessaey, just download form P58 and fill it out. It asks if you are the sender or receiver.

    It can takemonths for RM to pay up though!

    Personally my next action would be to print the note they sent you, and catch your local delivery man and ask him if he recognises the signature or remebers where it was delivered.

    Stupid advice

    the OP had a contract with the seller and should deal with the seller, if he starts doing all this its then upto them and not the seller and if it all goes wrong at the RM end again then there screwed

    OP - you bought items which havent been delivered, insist the seller either deliver or recompense you. A compensation claim by them against RM is not your business so dont get involved.

    Thank you LinasPilibaitisisbatman for your advice. I have gone through paypal to see if we can get a refund through them, the seller is not budging on this matter and will not consider a refund, he prefers to believe RM, who have a signature to prove goods have been delivered (somewhere???)

  • If there is a signature for delivery then PayPal may not pay up. From your point of view you haven't had the goods so who has? (Have you checked that a neighbour hasn't taken it in for you). From your sellers point of view you appear have signed for your goods so why should he/she send another as they will be out of pocket too? Bit of a no win situation but I would expect the seller to cooperate a little more by kicking up a fuss with Royal Mail. If they or you have spoken to the general customer service line then you won't get far and you would be better calling into your local postal depot to speak to someone there and see if they can help you.

    Ask your seller to contact Royal Mail to send you a letter so you can sign to say you haven't had the parcel. Then they should pay out your seller and they can compensate you too.

    is the chard office your local office?
    you will not get a claim from RM as it shows delivered
    RM do not tally tracking codes with delivery addresses so theres no trail to confirm the item was sent ot your address
  • Assuming that the seller isn't trying to stitch you up....

    Put yourself in the seller's shoes. They've sent the item via Royal Mail, a trusted company, who are telling them that they have safely delivered the item. Would you want to then resend another one if the seller suddenly claims that it hasn't been received?
