Bankruptcy hearing tomorrow - urgent advice needed

[FONT=Verdana, Arial, Helvetica]I have my bankruptcy hearing tomorrow but I'm really concerned about two things.

My husband left me in September and as a consequence I lost my job. I have three children and am now surviving on benefits.
I have £27,000 of debt and have been advised by debt advisors to apply for bankruptcy.
What concerns me is that in January I applied and recieved a payday loan for £130 although I no longer had a job - as I'm guessing this is obtaining money fraudulently, how will this be dealt with and will it affect the decision on my bankruptcy?

Also, I have recieved money from friends and family into my current account to help me out since my husband left - will the OR question this?

I'm so worried about tomorrow, I need this bankruptcy to happen or I don't know what I'll do. I have made stupid mistakes in the past and am willing to pay for them and would be happy to never recieve credit again in my life, I just need to be prepared for what will happen to me..

    What's done is done, as far as I can tell the BR will go ahead no matter a bout the loan or any thing else. You could say you used the money for fees or for living. I am sure you will be fine, but know doubt someone wiser than me will be along shortly

    I'm no expert but am in a similar situation myself, i took out a a couple of loans in January this year but am now going bankrupt. I think it will not affect whether you get made bankrupt or not but you may receive a BRU/BRO at a later date. I'll let others offer more expertise but just wanted to say you're not the only who's done this and offer some support.

    I wouldnt worry, the OR has seen this lots of times, and the bottom line is you have to feed yourself and your children. Dont worry, I would of done the same in your position.

    Yes, if you declare it. Depends how much it was. Could you pay them back privately.

    The actual court day is never as bad as people think. Take a deep breath and in you go. I actually was fascinated by the whole day. You have done nothing wrong, hold your head up!

    I doubt the OR will get too concerned about the pay day loan, it's a relatively low amount.

    It would also be classed as not material, so would not lead to a BRO/BRU on it's own.
  • thanks for the replies, have been so worried.. I guess it's the fact that the hearing is looming that's worrying me.

    I haven't declared any of the money that friends and family have given me, I will pay them back as and when I can afford to, they all understand. Just wondering if the OR will query the amounts paid into my account as it makes my income more than declared? It was for essentials, so nothing untoward. Will just have to suck it and see I guess!

    Fingers crossed for tomorrow and another chance at life...

    Were these loans from family/friends, or were they just helping you out? If they were just helping you out and are not expecting to be paid back there's nothing to worry about, you've done nothing wrong, the OR won't care.

    If they were loans they should strictly speaking go on your forms as creditors, but only you can decide if you want to do that.

    EDIT: OK, just seen your reply, the OR won't think your income is higher, if they do question it just tell the truth, it was friends & family helping you out. You don't have to mention that you will be paying them back as and when you can afford to.

    Just feel so tense tonight, worrying about every little thing..

    Actually one other quick question if you don't mind..

    I'm on benefits and have completed the form to waive court fees, so am I right in thinking I only have to pay £345 tomorrow? Don't want to go in with the wrong amount..

    Can you tell I'm panicking??

    Yup, just the £345. But make sure you have proof of your benefits dated within the last month. And don't panic :D
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    I'm a former bankrupt (year 2000)...so my advice- have a glass of wine and do not worry! The receiver only wants to know if there has been fraudulent goings-on (ie selling an expensive car to a relative for 20 quid)...so money given to you by friends to keep you going is totally ok!- not loans...gifts!!!- I used all sorts of excuses to explain where my money had gone, all very sensible and reasonable (including 15 grand I had spent on setting up my rented flat!!!)
    If you have any money in a bank account- empty it tonight/tomorrow- keep it for what you need (it will be frozen). Cry and get emotional at your meeting...I nearly did (and I'm a bloke) and it works in your favour!
    Be firm with these people...contrite and apologetic is fine, but do not let them bully you- this is not all your fault and don't let them make you feel like a criminal- you are not at all!!!

  • Hello there, I went BK in November and please do not tie yourself if nots about the court date. I personally (but I am no expert) wouldnt worry about the pay day loan, I bet the OR wont even question it and friends and family helping out, are just friends and family helping out. It sounds like you have had an awful time with your husband leaving you and I can imagine how upset you have been. At the end of the day I alway think unless you have done something repeatedly with no caution, or no need for the money, and just for the hell of it, i dont think the courts/OR would look badly at someone. The fact you post on here, and are this worried, to me tells me your a good consciencious person, so i dont think you should beat yourself up. Just be honest.
