Next Payment Protection

Hi, I wrote a letter to Next asking for the PPI payments I have made to them back and had this reply:

"I can confirm that PPI on your account started on 18 July 2000 and has been included in every monthly statement since that date.
At the time your account was opened, you would have had to specifically request that the policy be taken out, either by ticking the appropraite box on a directory card request form or by verbally requesting an application form by telephone.
It then goes on to say that the FOS will only consider cases referred to them by the FSA after April 2007, and as the policy was taken out in 2000 and they were not regulated by the FSA before January 2005 the rules imposed by the FOS do not apply in this case.

Sorry it's so long winded, I can't ever remember asking for PPI specifically, it's just always been on my account, are they right can this not be claimed back?

If anyone knows , any help will be appreciated.:o

    Hi there

    They do tend to fob off when they know they have an excuse to cover themselves such as not being regulated etc, however there is a Financial leasing association you can contact, maybe they could help in your case, I hear that some are successful with these and others not, but there is no harm in contacting them just to find out:

    Have you still the agreement for this by any chance?

    You may also like to ask them to provide documents to show that either a phone call or a tick took place.They have to prove it WASN'T mis sold.
    The FOS can't help ,you may have to go to court or do money claim on line.
