How about setting up standing orders or direct debits for essential payments?

You know you are dyspraxic, you know you have problems remmebering to pay bills, so you need to sort yourself out.

Set up standing orders for everything important.

You need to make sure that priority bills are paid on time - that includes your rent.

Saying you are disorganised is no excuse. Set up systems to get round the problems. It is your job to pay your rent on time, set up a standing order to do so.

Using dyspraxia as an excuse for prioritising non-priority bills of your priority bills like rent is pathetic.

If you have a computer and/or a moblie you can set up reminders in the calendars.

I use these to remind me of things like 0% running out on a CC deal or final payments ofr a holiday.

The computer will pop these up so you only have to remember to use the computer every day.

Make an appt to see the CAB or ring shelter for advice on what to do.

Obviously miscommunication all round has led to this situation so you need to work hard to get it sorted out.

Unfortunately while the court may wish to be lenient (it would be a judge), if two months rent is unpaid at time of service and hearing then the court must award possession to the LL and evict the T. There is no discretion available to the courts.
Unfortunately? It's the landlord's property and if the tenant is in substantial breach of the contract then they can have few complaints if the contract is terminated.

OP, you have a recognised medical condition, and IT IS upto people to make allowances for your 'disability.'

    Why?

When OP took on the property did he tell the landlord that he has a disability that means that, not only he might not pay the rent for 3 months, but that he won't notice that the rent hasn't been paid and when prompted will have spent the money on something else?
As for them not [STRIKE]sending you reminders[/STRIKE] paying the rent, this is frankly people all over. They're so utterly useless that they may as well be disabled. Good business practice would be a [STRIKE]polite reminder[/STRIKE] standing order, NOT a load of [STRIKE]threats[/STRIKE] weak excuses months later out of the blue.

Sorry, ts-aly2000 but I am struggling to reconcile your "support" for the OP here, in which you are attacking other posters' responses, with the second sentence of your paragraph, as quoted below. I find that comment quite offensive: perhaps I have misinterpreted what you are saying, and you could clarify?

On the subject of reminders, when a T takes on a property they have a legal obligation to pay their rent in full and on time. Had the OP highlighted their dyspraxia to the LA/LL at the start of the tenancy? If s/he did, did they explain what his/her exact difficulties were likely to be? It is not clear whether the OPs partner is a joint signatory to the tenancy, but s/he too surely has a role to play. The LA should have sent notices to both the LL and the T that rent arrears were building up but the T also has to account for their actions and omissions. However, there have been some interesting posts on Nearly Legal and Landlordlaw on a recent case on tenancy and the Disability Discrimination Act.

Rob - as other have said you have to prioritise your rent payments at all times and you need to get some professional support with this straight away. Is there a law centre in your area? Check here- link You could talk to someone at Community Legal Advice on 0845 345 4 345 (m-F 9-6.30pm, 4p a min charges but you can ask them to call you back) or at Shelter 0808 800 4444 (7 days, 8-8). Don't waste any more time posting on here - speak to someone this afternoon if you can.

    I was being kind.
  • Where do these places exist where you can just pay your rent when you choose?
My Letting Agent enforced that we had a Standing Order setup on the day I got the keys. Its so much easier because I don't have to give it a second thought it just comes out as standard every month.
