You say that they have refunded charges twice in the past why was this? Whose mistakes were they?

May I just say that you are quite right; if a bank makes a mistake they should compensate you for any loss that you may have incurred through their mistake.

If a customer makes a mistake, then legally the bank is entitled to be compensated for any loss incurred through the customers mistake.

NOT make an extortionate profit from it - £39 for writing a letter and pressing a few buttons (assuming it's not done automatically as I suspect it is), maybe not even as much as that.

If the cost to the bank was for a few pence, then the customer should pay the few pence back, as would be expected the other way around.

They said that they wont offer me a good will gesture as there has already been two, and they only offer one in a life time.

So they have decided to comply with basic contract law twice and so now they won't do so again - think again Nationwide - I would give them 7-14 days to comply with the law or start proceedings against them.
