RBS Refusal to provide me with past credit agreements

Ive recently sent a a letter to RBS (downloaded a template letter from this site) requesting that they send me information about the credit agreements, and the ppi insurance that i have had on loans with them in the past, as I dont have the original paperwork. I have had various loans with them between 1999 to the present day, and at present my loan does not have inurance on it. They have told me that other than my current loan with them they do not have to provide me with copies. Is this right? I knew I was pushing my luck trying to get the agreement from 1999 because of the 6 year limit, but I thought they had to provide you with the information they hold on.

    Unfortunately its 6 years, sometimes when you request information for example in a Subject Access Request (SAR), yet I was lucky to receive some information going back even further than 6 years, but you cannot guarantee they will.

    If you still need info, there may still be some useful info in the last 6 years, there is SAR template letter on the thread - with details, although there is a charge of £10 cheque or postal order payment, they have 40 days to comply and post by recorded delivery.

    If you still have trouble receiving any info from them, you can always contact the Information Commissioners Office (ICO) who should be able to direct you here, it may be worth while checking their website out as well which gives you more of an idea of data information.;)

  • Sorry I havent been clear. I have had loans with them within the last 6 years (aswell as the one I have now). There letter just states that they do not have to provide me with copies of the info I require, other than the current loan I have with them.

    Hmm I see, well to my knowledge if its within the last 6 years they should provide you the information, of course by using the SAR (Subject access Request).
    I would ring the ICO and see what they have to say about this hun, good luck and please keep us posted and if you need any help with anything please just post up anytime.;)

    From what you said OP it sounds like you just asked for the info. I would say that they don't have to provide it to you on this basis but if you submit a SAR then they would.

    Just thought Id let you all know that Ive been in touch with the information commissioner who have told me that Rbs are breaching the data protection act, as the letter I sent them was a subject access request. Ive just written back to them to let them know what ive found out. Be aware they are trying to get out of providing information at any costs!!!

    Yes theyve asked me to send them copies of all my correspondance with RBS, and they are going to investigate them, theyve told me to complain to the FSA too. Fingers crossed this will get me the information I am entitled to:)) There must be something that they dont want me to see.
