    Hi

Just thought Id let you all know that Ive been in touch with the information commissioner who have told me that Rbs are breaching the data protection act, as the letter I sent them was a subject access request. Ive just written back to them to let them know what ive found out. Be aware they are trying to get out of providing information at any costs!!!

Did you send the £10 fee? if not then I don't think they are breaching any act

They cant decide not to sendd me information because they want a fee off me without actually telling me they want a fee, it doeasnt add up. Surely all they would have to do is ask?? There is no other explanation than they were breaching data protection, and trying to pull a fast one. The Information Commisioner has rang them and told them theu ate in breach, to this they have told them that my past credit agreements have been posted by special delivery to me, (obviously posted after the conversation with the informationcommisioner). HA HA, they missed the bit out that they sent me a letter saying they were not obliged!!! Semms like there is abit of lying going on somewhere:) Anyway, Ive got a special delivery awaiting my collection at the post office:) Semms like my persistance has paid off. DO NOT TAKE WHAT THEY TELL YOU AS GOSPEL-Thats what Ive learnt, Im escpecually interested as to what I will find after their shennanigens!!

    Ill keep you posted

Do you have a sarn template?. I will gladly provide you with one.
One SARN for all loans as long as you put the agreement numbers on the SARN.
Anything redeemed under 6 years they will have to provide.

For reference the lenders will use this ploy of not co-operating more and more.
I am reliably informed that this will become common place.
I am a former Broker, former IFA and former compliance officer, for my sins.

However, I have since seen the light.

    Hello

Ive just seen you reply. I have sent a sarn well at least thats what I think It was I down loaded a template from this site. Rbs have (surprise, surprise) now sent me a letter saying that they now inclose copies of my loan agreements subject to me sending a sarn however; they only date back to Oct 06 whcich surprisingly is to a time when I took out a loan without loan insurance;), and they know very well that I had loans during this time with them!! Im getting abit annoyed to be honest and dont jnow what to do for the best. Would it be wise to threaten them that I am instructing a no win no fee solicitor to take over my position who could then do this for me and decide if I have a case? I have just informed the information comissioner of this update.

I would inform RBS that you have contacted the information commissioners regarding this issue and formally request the information that is missing.

    Hi

Yes they told me they have spoke with RBS who said they would send out the info requested by special delivery, Ive just received it and its not complete. They told me to get back in touch if their were further problems as they could issue them formerly with something that said they had to give me the info required but whether they choose to issue was up to them. They did say that they told RBS that had breached Data Protection Law. If they did decide to issue and RBS refused then it would mean that it would go to court. Im just wondering whats going to happen if the commisioner refuse to issue as its looking like they are ignoring them
