Court claim wording - credit card charges

Does any body know how to change the wording of this if I want to claim the full amount after receiving an amount from the card company already which I have accepted as a payment without prejudice?

5. Claimant claims: (a) return of the amounts debited of [insert total charges]; (b) Interest per S.69 County Courts Act 1984 of 8% per annum from the date they were deprived of the money [insert amount of interest as calculated with the bank charges calculator] continuing at the daily rate of 0.022% until judgment or payment.

  • You can only claim the difference if you have already accepted an amount without prejudice.

    Thanks Natwest

When you say you accepted without prejudice what do you actually mean?

I claimed full amount, they offered £12 per charge, and sent cheque. I said ta and sent letter saying accept the cheque as part payment without prejudice but want the rest am prepared to go to court. Just wondered how to change the original text to say I want balance.

    This ok?
    Eg.

    5. Claimant claims: (a) return of the amounts debited of £420.00 (b) Interest per S.69 County Courts Act 1984 of 8% per annum from the date they were deprived of the money £120.25 c) Less £200.00 received as part payment without prejudice, continuing at the daily rate of 0.022% until judgment or payment.

Just didn't know how to word it. Thanks Natwest in advance

You do not need to state the amount of money received on account. You simply put the amount in dispute.

Also it should not be a %age in the final line.

    Thanks Tozer...so...
    Eg.

Hows that? No mention of the £200 on account, the full amount £420 less £200 and full interest £120.25. with no % mentioned.
